Economic operators submitting a tender must prove a form of registration under the law of their country of residence, demonstrating that the economic operator is legally established, is not in any situation of annulment of incorporation, and possesses the professional capacity to carry out the activities subject to the public procurement contract. This requirement also applies to subcontractors for the part of the contract they are to perform, who shall fill in the information relevant to their situation in a separate ESPD. In order to demonstrate fulfillment of the criterion regarding suitability to pursue the professional activity, the Sole Tenderer/Associated Tenderer shall complete the ESPD - Part "Selection criteria" - Section A. The tenderer ranked first in the intermediate ranking drawn up upon completion of the tender evaluation shall submit, at the request of the Contracting Authority, for each individual lot, the supporting documents proving the fulfillment of the commitments made by completing the ESPD, namely the Confirmation of Company Details (Certificat Constatator) issued by the Trade Register Office attached to the Territorial Court, certifying that the subject matter of the contract corresponds to the activity of the tenderer/associated tenderer for the part of the contract they perform. For foreign legal entities, conclusive documents proving a form of registration in accordance with the legal provisions of the country in which the tenderer is established shall be submitted, reflecting the information requested by the Contracting Authority. The submitted documents must be genuine/valid on the date of their submission. Other minimum information that must be included in the certifying document are: - legal identification data (name, registered office, unique registration code); - main and secondary activities; - legal representatives. Note 1: In the case of an association, documents shall be submitted for each member of the association. To fulfill the requirement, it is sufficient for each member's scope of activity to be consistent with the part of the contract they will perform. Note 2: In the event that parts of the contract are executed by subcontractors, proof of registration and the correspondence of main/secondary activities therein with the subject matter of the procurement must also mandatorily be submitted by the subcontractors for the part of the contract they will perform.

In the event that the bidder will subcontract a part of the contract, the bidder is obliged to declare in the DUAE the subcontractor(s) and to complete the section 'Selection Criteria' - Section C - subsection 'Proportion of subcontracting'. If the bidder uses the capabilities of the subcontractor(s) within the contract, each subcontractor will complete a separate DUAE form which will include Part 'Exclusion Reasons' and Part 'Selection Criteria' - Section A. If the bidder will subcontract a part of the contract, the bidder will present, along with the submission of the DUAE, the subcontracting agreement - Form no. 4. Subcontracting contracts must be in accordance with the offer and will constitute annexes to the public procurement contract. If the subcontracting agreement/contract is concluded in a language other than Romanian, an authorized translation into Romanian must also be presented. The contracting authority requests the bidder to specify in the offer: a) the categories of services from the contract that they intend to subcontract; b) the percentage or value related to the activities indicated in the offer as being carried out by subcontractors; and c) the identification data of the proposed subcontractors, if they are known at the time of submission of the offer. Note: The contractor's liability regarding the manner of performance of the contract is not diminished if part/parts of it are performed by subcontractors. The method of fulfilling the requirement: 1. The bidder will declare in the DUAE the subcontractor(s) and will complete the section 'Selection Criteria' - Section C - subsection 'Proportion of subcontracting'. 2. Each subcontractor will complete a separate DUAE form which will include Part 'Exclusion Reasons' and Part 'Selection Criteria' - Section A, for each lot separately. 3. If the bidder will subcontract a part of the contract, the bidder will present, for each lot separately, along with the submission of the DUAE, the subcontracting agreement Form no. 4. Subcontracting contracts must be in accordance with the offer and will constitute annexes to the public procurement contract. If the subcontracting agreement/contract is concluded in a language other than Romanian, an authorized translation of it into Romanian must also be presented. 4. The bidder ranked first in the interim ranking drawn up at the completion of the evaluation of the offers, at the request of the contracting authority, will present, for each lot separately, relevant documents regarding the technical and professional capacity of the proposed subcontractors concerning the part/parts of the contract that they are to effectively fulfill.
