Modernization of public administration through the implementation of an Integrated Information System in the Commune of Filipeștii de Târg

Economic operators submitting tenders must prove a form of registration under the law of the resident country, showing that the economic operator is legally constituted, that he is not in any of the situations of annulment of the constitution, and that he has the professional capacity to carry out the activities covered by the contract. The requirement shall also apply to subcontractors, where applicable, who shall supplement the information related to their situation at the level of a distinct DUAE.

Method of implementation: The DUAE shall be completed by the economic operators participating in the procedure for awarding the public contract in the SELECTION CRITERIA section, ticked "Yes" or "No," being activated option "α: the global indication for all selection criteria in accordance with the provisions of Article 193 paragraph (6) of Law No. 98 / 2016, with subsequent amendments and additions.

At the request of the contracting authority, only the tenderer ranked 1st in the intermediate ranking resulting from the application of the award criterion to admissible tenders shall submit supporting documents proving the fulfilment of those assumed by completing the DUAE.

For foreign legal / natural persons: Equivalent documents shall be submitted to prove the registration / authorisation or membership, from a professional point of view under the law of the country of residence, showing that the economic operator is properly constituted, that he is not in any of the situations of cancellation of the constitution and that he has the professional ability to perform the activities covered by this contract in connection with the above mentioned requirements and the regulations applicable in the country of origin / country in which the economic operator is established, in the language in which they were issued, in a legible copy with the words "in accordance with the original', accompanied by an authorised translation into Romanian.

The subject-matter of the framework agreement shall be corresponding in the fields of activity shown in the documents submitted. The information contained in these documents shall be real / valid on the date of its submission.

NOTES: - in case of participation with the joint offer (of an association), documents shall be submitted for each of the members of the association for the part of the contract they make; - where parts of the contract will be executed by subcontractors, proof of registration and correspondence of the principal / secondary activities within the contract with the object of the acquisition will also be submitted by subcontractors for the part of the contract they will perform.

Justification: By requesting that this requirement be met, the contracting authority wishes to ensure that economic operators are registered under the legislation of the country of origin and that they have the legal right to conduct economic activities corresponding to the subject-matter of the contract.

The bidders will provide proof that in the last 3 years calculated up to the limit date fixed for the submission of tenders they have supplied similar products to the object of this contract in the aggregate value of at least 3,000,000,00 lei without VAT, at the level of maximum 3 contracts.

"Similar project means a software development project and / or implementation of a solution and / or computer system" The number of years required to demonstrate similar experience will be reported at the closing date for submission of tenders.

Those certifications / documents will have to indicate: a. the subject of the contract in such a way as to provide all the information required and necessary to verify the fulfilment of the requirement for similar experience; b. the beneficiaries, whether they are contracting authorities or private customers; c. value - in MDL without VAT; d. period, i.e. the periodic interval (starting date and finalisation date) during which the contract was executed; e. quality of the tenderer in carrying out the contract presented as similar experience.

Non-resident economic operators (foreigners) will submit copies of any documents confirming the provision of similar services, accompanied by their translation into Romanian (carried out by an authorised translator) The supply activity cannot be subcontracted in view of the provisions of art. 3 para. (1) letter yy) of Law no. 98 / 2016 - "subcontractor / sub-contractor - any economic operator that is not part of a public procurement contract and that executes certain parts or elements of the works / services, responsible in front of the contractor for the organization and conduct of all stages required for this purpose.
