What the buyer wants
The municipality of Schemmerhofen is constructing a passive fiber optic network (FTTB) in the municipal area as part of the funded expansion of the gray spots in accordance with the Federal Gigabit Directive 2.0 (operating model according to No. 3.2). The municipality carries out the planning and construction of the passive network separately. The grid commissioning is currently planned for 2030. According to the non-binding forecast (Appendix 2 task description, customer potential and route concept, point 3.4.2), the expansion area is expected to comprise around 810 addresses. The Municipality does not provide network services and Internet and telecommunications services itself. The purpose of this invitation to tender is therefore to lease the passive fibre network to a network operator which, by way of a service concession, ensures the operation of the network, including the deployment and operation of active technology, and provides Internet and telecommunications services, including bundled services, to private and commercial final customers. The network operator is also responsible for granting open access with active and passive wholesale products; the wholesale prices bindingly fixed by the Confederation with the participation of the Federal Network Agency are considered as an upper limit. In addition, maintenance, maintenance, repair, suppression, documentation and services as well as associated services. The passive infrastructure shall be leased on the basis of the network operation and lease agreement. The subject matter is exclusively addresses of the backdrop gray spots (Gigabit Directive 2.0). The network established under the ‘White Areas’ programme and already allocated for operation and the municipality’s backbone/feeder network, with which the subject of the tender is partly technically interwoven (see Annex 2, points 3.1 to 3.3), are excluded. July 2023; Grant decision of 10.02.2025 (FOBIS-ID 2000384064); 4-8433.6/7 The subsequent contractor must comply with all requirements of the grant notices on which the project is based with ancillary provisions, instructions, conditions, leaflets and attachments as well as the relevant funding programmes.
Gegenstand dieser Ausschreibung ist die Verpachtung des passiven Glasfasernetzes (FTTB), das die Gemeinde Schemmerhofen im Rahmen des geförderten Ausbaus der grauen Flecken (Betreibermodell nach Nr. 3.2 der Gigabit-Richtlinie 2.0 des Bundes in der Fassung vom 31.03.2023) errichtet, an einen Netzbetreiber, der im Wege einer Dienstleistungskonzession den Netzbetrieb sicherstellt sowie Internet- und Telekommunikationsdienste gegenüber privaten und gewerblichen Endkunden erbringt. Dem Netzbetreiber obliegt zudem die Gewährung eines offenen Netzzugangs (Open Access) mit aktiven und passiven Vorleistungsprodukten; die vom Bund unter Beteiligung der BNetzA verbindlich festgelegten Vorleistungspreise gelten als Obergrenze. Hinzu kommen Wartung, Instandhaltung, Instandsetzung, Entstörung, Dokumentation und Serviceleistungen sowie zugehörige Leistungen. Die Überlassung der passiven Infrastruktur erfolgt nach einem Pacht- und Netzbetriebsvertrag Die Leistung wird als ein Gesamtlos vergeben.

The applicant or the applicant community must maintain a company liability insurance with a minimum cover amount of EUR 10,000,000 per claim for personal injury and EUR 5,000,000 for material damage per claim with an insurance company licensed in a member state of the EU or a contracting state of the Agreement on the European Economic Area or, in the case of award of a contract. The minimum annual turnover net of the applicant or the applicant community according to § 45 Abs. 1 No. 1 and para 4 No. 4 VgV (corresponding) must have reached the following amount per financial year with regard to the area of the services to be awarded and other services comparable to the service to be awarded, including the share in the case of services carried out together with other companies in the last 3 financial years (minimum requirement in the competition for participation): Minimum annual turnover: 470.000,00 Euro net In the case of subcontractors, an addition of the turnover takes place only in the case of the economic qualifying loan after submission of corresponding declarations of commitment by the subcontractors according to the Form Commitment Subcontractor.
The applicant or the candidate community must have provided at least three references of services comparable to the services to be awarded in the last five years; The relevant period shall be the period of five years before the expiry of the time limit for participation. Similar in this sense are projects relating to services related to the development of active technology and the active operation of a telecommunications network with connected final customers and the provision of retail services (Internet, telephone, television) to final customers. The services must have already been provided in substantial parts during the aforementioned period. This is the case if more than 30% of the telecommunications network of the respective reference has been equipped with active technology.
