   OEW Breitband GmbH (OEW BB) has been commissioned by the Municipality of Uttenweiler to tender on behalf of the Municipality the network operation in the passive fibre network to be built on the Municipality territory. The municipality of Uttenweiler is expected to carry out the tender for planning services at the end of 2026 / beginning of 2027 as well as for construction services in order to develop the light and dark grey areas of the municipal area. At the earliest by the end of 2027, construction is expected to begin. The completion of the projects and handover will then probably be at the end of 2029 or early 2030. The municipality of Uttenweiler as client (AG) does not provide services of network operation as well as Internet and telecommunications services itself. The subject of this invitation to tender is therefore the leasing of a passive fibre network to a service provider who, by way of a service concession as a contractor (AN), ensures network operation and also provides Internet and telecommunications services as a bundle offer to private and commercial end customers for a reasonable fee. In addition, the AN is responsible, among other things, for offering demanders both active and passive wholesale products, taking into account the information on wholesale prices of the BMDS of 31.03.2026 (see Appendix). In addition, there are services of maintenance, maintenance, repair and interference suppression and service as well as associated services. The transfer of the passive infrastructures of the AG to AN takes place by lease on the basis of a corresponding network operation and lease agreement. The subject of this lot call for tenders is exclusively address points which are developed via the HGF programme (light grey areas). In Uttenweiler, parallel to these address points, there is a broadband network under construction via the White Spots Programme (WFP), which is not the subject of this call for tenders. The project is funded as follows: - Directive "Promotion to support the Gigabit expansion of telecommunications networks in the Federal Republic of Germany" (Gigabit Directive), as amended by the Notice of 27.12.2022; E-Az. of the grant decision Confederation: 832.6/10-22 01BW21948 - Administrative provision of the Ministry of the Interior for co-financing of the Federal Directive "Promotion to support the gigabit expansion of telecommunications networks in the Federal Republic of Germany" (VwV Gigabitmitfinanzierung) of 10 September 2021; E-Az. of the grant decision Land: 4-8433.5/230 The subsequent contractor must comply with all requirements of the grant decisions on which the project is based with additional provisions, instructions, conditions, leaflets and attachments as well as the relevant funding programmes.

2. Lot 2Los 2 Uttenweiler - Teilgebiet dunkelgraue Flecken

   Die OEW Breitband GmbH (OEW BB) ist von der Gemeinde Uttenweiler damit beauftragt worden, im Namen der Gemeinde den Netzbetrieb in dem auf dem Gemeindegebiet zu errichtenden passiven Glasfasernetz auszuschreiben. Die Gemeinde Uttenweiler wird voraussichtlich Ende 2026 / Anfang 2027 die Ausschreibung für Planungsleistungen sowie in der Folge für Bauleistungen durchführen, um die hell- und dunkelgrauen Bereiche des Gemeindegebiets zu erschließen. Frühestens Ende 2027 wird mit dem Baubeginn gerechnet. Die Fertigstellung der Projekte und Übergabe wird dann wahrscheinlich Ende 2029 oder Anfang 2030 sein. Die Gemeinde Uttenweiler als Auftraggeberin (AG) erbringt Leistungen des Netzbetriebs sowie Internet- und Telekommunikationsdienste nicht selbst. Gegenstand dieser Ausschreibung ist deshalb die Verpachtung eines passiven Glasfasernetzes an einen Dienstleister, welcher im Wege einer Dienstleistungskonzession als Auftragnehmerin (AN) den Netzbetrieb sicherstellt sowie Internet- und Telekommunikationsdienste auch als Bündelangebot an private und gewerbliche Endkunden gegen ein angemessenes Entgelt zur Verfügung stellt. Darüber hinaus obliegt der AN u.a. die Aufgabe, Nachfragern sowohl aktive als auch passive Vorleistungsprodukte unter Berücksichtigung der Informationen zu Vorleistungspreisen des BMDS vom 31.03.2026 (s. Anlage) anzubieten. Hinzukommen Leistungen der Wartung, Instandhaltung, Instandsetzung sowie Entstör- und Serviceleistungen sowie zugehörige Leistungen. Die Überlassung der passiven Infrastrukturen der AG an die AN erfolgt im Wege der Pacht auf Grundlage eines entsprechenden Netzbetriebs- und Pachtvertrages. Gegenstand dieses Loses sind ausschließlich Adresspunkte, deren Erschließung über das DGF-Programm (dunkelgraue Flecken) erfolgt. In Uttenweiler befindet sich parallel zu diesen Adresspunkten ein über das Weiße-Flecken-Programm (WFP) im Bau befindliches Breitbandnetz, das nicht Gegenstand dieser Ausschreibung ist. Das Projekt wird wie folgt gefördert: - Richtlinie „Förderung zur Unterstützung des Gigabitausbaus der Telekommunikationsnetze in der Bundesrepublik Deutschland“ vom 31.03.2023 (Gigabit-Richtlinie 2.0); E-Az. des Zuwendungsbescheides Bund: 832.6/10-23 04BW20374 - Verwaltungsvorschrift des Innenministeriums zur Mitfinanzierung der Bundes-Richtlinie „Förderung zur Unterstützung des Gigabitausbaus der Telekommunikationsnetze in der Bundesrepublik Deutschland“ (VwV Gigabitmitfinanzierung) vom 27. Juli 2023; E-Az. des Zuwendungsbescheides Land: 4-8433.6/6 Vom späteren Auftragnehmer sind sämtliche Vorgaben der dem Projekt zugrundeliegenden Zuwendungsbescheide mit Nebenbestimmungen, Hinweisen, Auflagen, Merkblättern und Anlagen sowie der einschlägigen Förderprogramme einzuhalten.
