What the buyer wants
For the City of Tengen, providing citizens and commercial enterprises with high-performance and future-proof broadband services is an important task in terms of public services of general interest, economic development, and safeguarding the business location. With the requirement for high data rates and long transmission distances between networks, the expansion of fiber-optic technology plays a decisive role. For this reason, the City of Tengen has in recent years established a fiber-optic infrastructure to ensure high-performance and future-proof provision in parts of the urban area. For this purpose, starting from connection points to existing fiber-optic infrastructures, feeder infrastructures into the service area (backbone network) as well as local distribution networks in underserved areas of the urban area were established based on FTTC (as an intermediate step) and FTTB technology. The network operator of the existing backbone network and the existing local distribution networks (FTTC and FTTB) is Stiegeler Internet Service GmbH, Schönau. Based on this infrastructure, the City of Tengen plans to establish a subsidized gigabit network based on FTTB technology in the cadastral areas specified under Section A.3 successively between 2027 and 2030. Starting from the existing backbone network, the subsidized gigabit network (FTTB) consists of feeder infrastructures into the service area as well as local distribution networks in the respective expansion areas. An overview of the planned gigabit network (FTTB) and a cartographic representation of the expansion area defined by address points can be found in the Service Area annex (Anlage Versorgungsgebiet). The project is funded under the directive "Funding to support gigabit expansion of telecommunications networks in the Federal Republic of Germany" (Gigabit Directive of 26 April 2021) and the Administrative Regulation of the Ministry of the Interior on the co-financing of the Federal Directive "Funding to support gigabit expansion of telecommunications networks in the Federal Republic of Germany" (VwV Gigabitmitfinanzierung) of 10 September 2021. The provisional federal grant notifications and the grant notification of the State of Baden-Württemberg for co-financing the project are attached to the tender documents in the Grant Notifications annex (Anlage Zuwendungsbescheide). This newly created passive gigabit network (FTTB) is to be transferred successively to a private-sector network operator as turnkey subnetworks for use and establishment of the active network level as well as the provision of high-bit-rate broadband connections against payment of a lease fee. Furthermore, network expansions built at a later point in time, for example through densification in settlements or development of new building areas, are to be handed over to the network operator after their completion and form part of the subject matter of the tender. The award of network operations is carried out in a single spatial lot as follows: City of Tengen Funding under Gigabit Directive The expansion area comprises the cadastral area according to Section A.3. In a first step, the contracting authority will establish a gigabit network (FTTB) in the cadastral area to connect grey spots in accordance with the Gigabit Directive. At a later point in time, network expansions—for instance, through densification in settlements or development of new building areas—are to be carried out, which will be handed over to the network operator after completion and also form part of the subject matter of the tender. Für die Stadt Tengen ist die Versorgung der Bürgerinnen und Bürger sowie der Gewerbetreibenden mit leistungsfähigen und zukunftsträchtigen Breitbanddiensten ein wichtiger Auftrag im Sinne der Daseinsvorsorge, Wirtschaftsförderung sowie der Standortsicherung. Mit der Anforderung hoher Datenraten und langer Übertragungsstrecken zwischen Netzwerken spielt gerade der Ausbau der Glasfasertechnologie eine entscheidende Rolle. Aus diesem Grund hat die Stadt Tengen in den letzten Jahren eine Glasfaserinfrastruktur zur Sicherstellung einer leistungsfähigen und zukunftsträchtigen Versorgung in Teilbereichen des Stadtgebiets hergestellt. Dieses neu geschaffene passive Gigabit-Netz (FTTB) soll einem privatwirtschaftlichen Netzbetreiber sukzessive als betriebsfertige Teilnetze zur Nutzung und Herstellung der aktiven Netzebene und der Versorgung mit hochbitratigen Breitbandanschlüssen gegen Entgelt überlassen werden.

The applicant or the applicant community must have provided at least three references on services comparable to the services to be awarded in the last five years. Similar in this sense are projects relating to services related to the development of active technology and the active operation of a telecommunications network with connected end customers and the provision of retail services (Internet, Te-lefon, television) to end customers. The services must have already been provided in substantial parts in the aforementioned calendar years. This is the case if more than 30% of the telecommunication network of the respective reference has been equipped with active technology.
The applicant or the applicant community must maintain a company liability insurance with a minimum cover amount of EUR 5,000,000 per claim for personal injury and EUR 5,000,000 for material damage per claim with an insurance company licensed in a member state of the EU or a contracting state of the Agreement on the European Economic Area or, in the event of a contract award. In the case of associations of applicants, it is sufficient that one of the members of the association has an insurance of an appropriate amount or provides it in the event of the award of the contract.
The minimum annual turnover net of the applicant or the applicant community according to § 45 Abs. 1 No. 1 and para 4 No. 4 VgV (corresponding) must have reached the following amount per financial year in the last 3 completed financial years with regard to the range of services to be awarded and other services comparable to the service to be awarded including the share of services performed together with other companies: 2.600.000 Euro net
