Economic operators submitting the offer must prove a form of registration under the law of the country of residence, from which to reiterate as an op. The information contained in this certificate must be real / current at the time of presentation and from which information about the structure of the shareholders, legal representatives, main / secondary field of activity, the CAEN codes related to them. The subject-matter of the contract must have the correspondence in the CAEN code of the certificate of finding issued by the ONRC. Non-resident (foreign) economic operators will provide equivalent documents proving a form of registration / attestation or professional membership under the law of the country of residence, showing that the economic operator is duly constituted, that he is not in any of the situations of cancellation of the constitution and that he has the professional ability to perform the activities covered by this contract in relation to the above mentioned requirements and the rules applicable in the country of origin / country where the economic operator is established. Note: a) if the tender is submitted in association, each associate will submit the mentioned DUAE document. b) In case the offer has technical / professional / financial support or contains proposals for subcontractors, the person providing support (third-party supporter) or the subcontractor will submit the mentioned DUAE document. The documents must be valid at the date of presentation.

Similar experience In accordance with Article 192 of Law 99/2016: "The economic operator proves the fulfillment of the criteria regarding technical and professional capacity by submitting, where applicable, one or more of the following information and documents: a) a list of the main deliveries of similar products made during a period covering at most the last 3 years calculated up to the deadline for submission of offers, indicating the values, dates, and public or private beneficiaries. Economic operators are required to demonstrate that they have delivered similar products to the subject of the contract within at most the last 3 years, calculated until the deadline for submission of offers set by the participation invitation published in SEAP, which shows that the bidder has delivered products of a nature and complexity similar/comparable to the products that are the subject of the contract/products of the type specified in the subject of the contract, for minimum cumulative values of 27,000,000 lei excluding VAT, at the level of a maximum of 3 contracts, regardless of the date of their commencement or completion, provided that the delivery presented as similar experience was made within the reference period. The documents required to support the requirement (acceptance minutes/contracts/parts of contracts and other documents indicating the values, dates, and beneficiaries of the products, issued or countersigned by an authority or by the beneficiary client) will be presented at the request of the contracting entity, at the end of the evaluation of the offers, only by the bidder ranked first in the interim ranking. For equivalence, the average annual exchange rate lei/currency communicated by BNR will be taken into account. If a group of operators submits a joint offer, then this requirement regarding similar experience will be fulfilled cumulatively by the participating operators. To demonstrate the fulfillment of the minimum requirement, only the bidder's participation share in the respective contract will be taken into account. The bidder's participation share represents the proportion of the total quantity/value of the contract corresponding to its participation in the respective contract. Fulfillment method Completion – DUAE - Unique European Procurement Document, according to Article 202, Law 99/2016. The supporting documents are the contracts with the beneficiaries of the works, as specified by the economic operator in the DUAE and the corresponding good execution certificates that prove the fulfillment of the commitments made by completing the DUAE, which will be presented at the request of the contracting entity, by the bidder ranked first in the interim ranking established at the end of the evaluation of the offers. In case the economic operator demonstrates the fulfillment of the criteria regarding technical and professional capacity based on the capacities of other entities, invoking, where applicable, the support of a third party, the DUAE, along with the commitment of support, must be completed separately by the supporting third party/parties. The DUAE presented by the supporting third party/parties will include all information mentioned in Article 202, paragraph (1), letter a) of Law 99/2016, as well as the information from Article 202, paragraph (1), letter b) of Law 99/2016 which is relevant for the support provided within the respective award procedure.

The tenderer must provide evidence of the holding of ISO 9001 (quality management system) and ISO 27001 (information security management system) certificates in force ISO 9001 Certification - It is necessary to certify the implementation of the quality management system according to the Romanian standard ISO 9001- 2015 or equivalent in order to increase the credibility and classification in quality of services, satisfy customer requirements, efficient use of resources and reduce non-compliance costs. Certification ISO 27001 - Certification of the implementation of the information security management system according to ISO 270001 standard for Information Security Management Systems (SMSI), defining requirements for the protection of privacy, integrity and availability of data through risk management. The economic operator will provide proof of the implementation of the mentioned systems, allowing both the presentation of certificates issued by certification bodies and other documents proving conclusively that the requirements are met. Method of meeting the requirements in the case of association: the requirement will be met individually by each member of the association for the part of the framework agreement it achieves. The documents must be valid at the date of presentation. Method of execution - ISO 9001 and ISO 27001 Complete - DUAE directly into SICAP - Single European Procurement Document. - DUAE Single European Procurement Document in accordance with ANAP Notification no. 237 / 2016. The DUAE shall be completed by the economic operators participating in the award procedure with the information related to their situation. The supporting documents proving the fulfilment of the quality assurance requirement assumed by completing the DUAE, i.e. certificates attesting the implementation of the mentioned or similar systems, granted by a national or international body, shall be submitted, at the request of the contracting entity, only by the highest bidder in the intermediate ranking drawn up on completion of the evaluation of tenders. Proof of the implementation of the management system SR EN ISO 9001 and SR EN ISO 27001, or equivalent, by presenting valid certificates issued by accredited certification bodies or other evidence / evidence confirming the assurance of an adequate level of quality and security of information. The latest version of the standards listed above will be respected, including amendments and erates.
