• Pursuant to Article 186 of Law 99 / 2016 on Sector Procurement, economic operators submitting tenders must demonstrate their personal situation (registration or professional membership in accordance with the legal requirements of the country in which the economic operator is established). In this respect, the economic operators submitting the tender must prove a form of registration under the law of the country of residence, show that the economic operator is legally constituted, that he is not in any of the situations of annulment of the constitution and that he has the professional ability to perform the activities covered by the contract. • Method of delivery: The economic operator will complete the selection criteria section of DUAE A. The supporting documents proving the fulfilment of those assumed by the completion of the DUAE, i.e. a finding certificate issued by the ONRC, or in the case of foreign bidders, equivalent documents issued in the country of residence, are to be submitted, at the request of the contracting entity, only by the highest bidder in the intermediate ranking drawn up after the evaluation of tenders has been completed. The supporting documents shall be valid on the date of presentation. The requirement shall also apply to joint tenderers, subcontractors, as appropriate.

Information and / or minimum level (s) required for the assessment of compliance with the requirements referred to in the Tender / Association may refer to subcontractors for the fulfilment of a part of the Sector Purchase Contract. If the tenderer / association calls on subcontractors to fulfil part of the sectoral procurement contract, the subcontractor / subcontractors shall be required to complete the DUAE. With the submission of the DUAE, the subcontracting agreement / agreements concluded between the contractor and the subcontractor / subcontractors nominated / nominated in the tender shall be deposited with the specification of the CATEGORIES OF CONTRACT SERVICES which they intend to subcontract, as well as of the CONTRACT PROCENT TO BE SUBCONTRACTED UNDER THE AGREEMENT. In accordance with Article 232 (4) of Law 99 / 2016, the contracting entity is required to require, upon conclusion of the contract, the submission of the contract / contracts concluded between the contractor and the subcontractor / subcontractors nominated / nominated in the tender. The supporting documents proving the fulfilment of those assumed by the completion of the DUAE are to be submitted, at the request of the contracting entity, only by the tenderer ranked 1st in the intermediate ranking drawn up after the evaluation of tenders has been completed.
