What the buyer wants
Neuenstein is a city in the Hohenlohekreis in the Franconian northeast of Baden-Württemberg. It belongs to the regional association Heilbronn-Franken. The city is divided into seven districts: Neuenstein, Kirchensall with Neureut, Kleinhirschbach, Obersöllbach, Eschelbach, Kesselfeld and Grünbühl. Neighboring communities are Kupferzell, Waldenburg, Öhringen, Zweiflingen, Forchtenberg, Niedernhall and Künzelsau. These are (clockwise, starting in the west): Öhringen, Zweifingen, Forchtenberg, Niederhall, Künzelsau, Kupferzell, Waldenburg. For the city of Neustein, providing citizens and businesses with efficient and promising broadband services is an important task in terms of public services, economic development and securing location. With the demand for high data rates and long transmission links between networks, the expansion of fiber optic technology plays a decisive role. Parts of the Neustein urban area are still insufficiently supplied with broadband connections in the sense of the Gigabit Directive 2.0. The project area was thus analysed in advance with regard to the available bandwidths and any planned in-house expansion of the private telecommunications companies by means of the implementation of a market exploration process in order to determine the expansion area of the eligible broadband expansion on the basis of the Gigabit Directive 2.0. The results of the market exploration carried out in compliance with the provisions of European state aid law were taken into account and published on the central online platform of the federal project promoter. It became clear that in parts of the requested area the gigabit capability of the network is not given and thus eligible connections in the sense of the Gigabit Directive 2.0 are available.

Ziel ist die Beseitigung noch vorhandener Grauer Flecken. Das Projekt soll mittels einer Zuwendung des Bundes für ein Wirtschaftlichkeitslückenmodell nach Nr. 3.1 der Richtlinie „Förderung zur Unterstützung des Gigabitausbaus der Telekommunikationsnetze in der Bundesrepublik Deutschland“ vom 31.03.2023, in der Änderungsfassung vom 13.01.2025 (Gigabit-Richtlinie 2.0), sowie nach der sowie nach der „Verwaltungsvorschrift des Innenministeriums zur Mitfinanzierung der Bundes-Richtlinie „Förderung zur Unterstützung des Gigabitausbaus der Telekommunikationsnetze in der Bundesrepublik Deutschland“ (VwV Gigabitmitfinanzierung)“ gefördert werden.

The applicant or the applicant community must have provided at least three references on services comparable to the services to be awarded in the last three years. Similar in this sense are projects relating to services and services related to the planning and deployment of passive infrastructure, the development of active technology, the active operation of a telecommunications network with connected final customers and the provision of retail services (internet, telephone, television) to final customers. The services must have already been provided in substantial parts in the aforementioned calendar years. This is the case if more than 30% of the telecommunications network of the respective reference has been set up and equipped with active technology ready for operation and more than 25% of the available end customer potential is supplied on the basis of corresponding (end) customer contracts. At least one of the three references must relate to a publicly funded broadband development project in which the applicant was a beneficiary or a selected operator.
The applicant or the applicant community must maintain a company liability insurance with a minimum amount of EUR 5,000,000 per claim for personal injury and EUR 1,500,000 per claim for property and/or property damage with an insurance company licensed in a member state of the EU or a contracting state of the Agreement on the European Economic Area or conclude it in the case of award of the contract. In the event of damage, both damage categories must be covered in parallel with each other with the above-mentioned sums of cover.
The minimum annual turnover net of the applicant or the applicant community according to § 45 Abs. 1 No. 1 and para 4 No. 4 VgV (corresponding) must have reached in the last three financial years (2023, 2024 and 2025) in relation to the area of services to be awarded and other services comparable to the service to be awarded, including the share of services performed together with other companies, at least the following amount per financial year: 1,000,000 euros net per financial year
Entry in a commercial or professional register in accordance with Annex XI to Directive 2014/24/EU of 26.02.2014 (EU Official Journal L 94/65).
