Procurement of IT workstations

M/1. The tenderer is suitable to perform the contract if it has reference(s) completed within three years, but commenced within a maximum of six years, calculated backwards from the date of dispatch of the call for tenders, performed in accordance with the contract and regulations, concerning the supply of at least 200 desktop computers.

Pursuant to Section 21/A of Government Decree No. 321/2015 (X. 30.), the Contracting Authority accepts if the result or activity according to the reference requirement was realized as partial performance of the contract. It also accepts realized performance in which a breach of contract occurred, but the economic operator's liability for breach of contract is undisputedly not established by the other contracting party.

If the performance deviated from the contract, the certificate or declaration must state the reason for and extent of the deviation, and whether the economic operator is liable for breach of contract. When certifying by own declaration, it must also be stated whether the other contracting party disputes the contractual conformity of the performance, or the statement regarding the lack of liability of the economic operator.

The required reference requirement can also be fulfilled by presenting several previous contracts (references).

Preliminary method of verification required in the tender and also necessary for the evaluation of tenders: In accordance with Section 67 (1) of the PPA and Section 1 (1) of Government Decree No. 321/2015 (X. 30.), the tenderer, or the economic operator participating in certifying suitability, must preliminarily certify by submitting the European Single Procurement Document (ESPD) that it meets the suitability criteria set by the Contracting Authority.

Pursuant to Section 2 (5) of Government Decree No. 321/2015 (X. 30.), the Contracting Authority accepts a simple declaration from the economic operator concerned for the preliminary verification of the suitability criteria.

If the tenderer intends to fulfill the prescribed suitability criteria by relying on the capacities of another organization or person, pursuant to Section 67 (3) of the PPA, the European Single Procurement Document must also be submitted in the tender on behalf of the capacity-providing organization in accordance with the provisions of Section 3 (3) of Government Decree No. 321/2015 (X. 30.), and upon the requirement to submit certificates, this organization or person – solely with respect to the suitability criteria – must certify compliance with the given suitability condition in the same manner as prescribed.

The tenderer or the economic operator participating in certifying suitability is obliged to submit the European Single Procurement Document completed in accordance with Sections 5–7 of Government Decree No. 321/2015 (X. 30.).

Upon the call of the Contracting Authority pursuant to Section 69 (4)–(7) of the PPA, the tenderer or the economic operator participating in certifying suitability is obliged to certify that it meets the suitability criteria determined by the Contracting Authority as follows: M.1/ Pursuant to Section 65 (1) point b) of the PPA and Section 21 (1) point a) of Government Decree No. 321/2015 (X. 30.), presentation by the tenderer of its most significant supplies for the 3 years (36 months) calculated backwards from the date of dispatch of the call for tenders, based on Government Decree No. 321/2015 (X. 30.), by certificate(s) issued by the other contracting party, or by a declaration made by the tenderer, or by a declaration of another organization participating in certifying suitability.

The case under Section 21 (1) point a) of Government Decree No. 321/2015 (X. 30.) must be certified as follows: a) if the other contracting party is an organization according to Section 5 (1) points a)–c), as well as points e) and f) of the PPA, or in the case of non-Hungarian organizations, an organization qualifying as a contracting authority under Directive 2014/24/EU…

M/1. The tenderer is suitable to perform the contract if it possesses reference(s) completed within three years, but commenced within at most six years, calculated backwards from the date of dispatch of the contract notice, concerning the supply of at least 20 portable computers/laptops, performed in accordance with the contract and the regulations.

Pursuant to Section 21/A of Government Decree No. 321/2015 (X. 30.), the Contracting Authority accepts if the result or activity according to the reference requirement was realized as partial performance of the contract. It also accepts performance that has taken place where a breach of contract occurred, but it is undisputed by the other contracting party that the economic operator bears no liability for the breach of contract.

If the performance deviated from the contract, the certificate or declaration must state the reason for and extent of the deviation, as well as whether the economic operator bears liability for the breach of contract. In the case of verification by means of an own declaration, it must also be stated whether the other contracting party disputes the contractual conformity of the performance, or the declaration regarding the economic operator's lack of liability.

The prescribed reference requirement may also be met by presenting multiple previous contracts (references).

Preliminary method of verification required in the tender and also necessary for the evaluation of tenders: Pursuant to Section 67 (1) of the Public Procurement Act (Kbt.) and Section 1 (1) of Government Decree No. 321/2015 (X. 30.), the tenderer or the economic operator participating in the verification of suitability must preliminary verify that it meets the suitability requirements determined by the Contracting Authority by submitting the European Single Procurement Document.

Pursuant to Section 2 (5) of Government Decree No. 321/2015 (X. 30.), the Contracting Authority accepts the simple declaration of the economic operator concerned for the preliminary verification of the suitability requirements.

If the tenderer wishes to comply with the prescribed suitability requirements by relying on the capacities of another organization or person, pursuant to Section 67 (3) of the Kbt., the European Single Procurement Document must also be submitted in the tender on behalf of the capacity-providing entity in accordance with the provisions of Section 3 (3) of Government Decree No. 321/2015 (X. 30.), and upon the requirement to submit certificates, this entity or person must—solely with regard to the suitability requirements—verify compliance with the given suitability criterion in the same manner as the prescribed verification methods.

The tenderer or the economic operator participating in the verification of suitability is obliged to submit the European Single Procurement Document completed in accordance with the provisions of Sections 5–7 of Government Decree No. 321/2015 (X. 30.).

The tenderer or the economic operator participating in the verification of suitability is obliged, upon the request of the Contracting Authority pursuant to Section 69 (4)–(7) of the Kbt., to verify that it meets the suitability requirements specified by the Contracting Authority as follows: M.1/ Pursuant to point b) of Section 65 (1) of the Kbt. and point a) of Section 21 (1) of Government Decree No. 321/2015 (X. 30.), presentation by the tenderer of its most significant supplies completed within 3 years (36 months) calculated backwards from the date of dispatch of the contract notice, based on Government Decree No. 321/2015 (X. 30.), by means of a certificate and/or certificates issued by the other contracting party, or by a declaration made by the tenderer, or by a declaration of another entity participating in the verification of suitability.
