The tenderer is unfit if he does not provide for the required performance within three years of the date of dispatch of the invitation to tender (36 months) completed but within a maximum of six years (72 months), at least Reference to transport 6 MSAN devices (or equivalent devices). MSAN tool definition: network tool providing data transmission voice communications and IP services on an IP (Internet protocol) and TDM (time division multiplexing) basis.

The quantity required in the competence requirement may be justified by several references. No 321 / 2015 (X.30) Pursuant to Article 21 (A) of the Corm Regulation, for the purposes of Article 21 (1) (a) of the Korm Regulation, contracting authorities shall also accept proof that the result or activity contained in the reference requirement has been achieved as part of the contract as proof of performance.

The applicant shall also accept evidence of the performance achieved where, although there has been a breach of contract, the economic operator's liability for breach of contract, not contested by the other party to the contract, does not exist. Certification: Under § 67 (1) to (3) of the Kbt, the tenderer is required to submit a declaration in respect of compliance with the eligibility requirements in the single European procurement document (EEKD).

The applicant does not request the provision of detailed information in Part IV of the EEKD; it is sufficient to complete section "alpha 'in Part IV.

According to § 69 (4) and (6) Kbt, the eligibility requirements for the tenderer invited to submit certificates shall be demonstrated as follows: Article 21 (1) (a) of the Korm Regulation provides that a description of the most significant deliveries which have been completed in three years (36 months) from the date of dispatch of the invitation to tender and started within a maximum of six years (72 months). The declaration or certificate shall contain at least the following particulars:

• the date of delivery (starting and ending date, year / month / day),
• the details of the other party to the contract (name, address / place of business),
• the description of the products transported (in such detail as to ensure compliance with the eligibility requirements) and the quantity, the declaration of compliance with the specifications and the contract.Where the performance has not been carried out in accordance with the contract, the reasons and the extent of the derogation in the certificate or declaration and, in the event of a breach of the contract, the fact that the economic operator is liable for breach of contract shall be explained.Where the certificate of suitability is made by a declaration of the tenderer, candidate or other organisation involved in the verification of the suitability, the declaration shall also state whether the other party to the contract disputes the nature of the performance contract or, where the economic operator has declared it, the fact that the economic operator is not liable for breach of contract.The required eligibility requirement may be met by joint tenderers in accordance with § 65 (6) Kbt. Article 65 (7), (11) to (12), Article 67 (3), Article 69 (11), (11a) and 321 / 2015 (X-30) Article 1 (7), Section 22 (2), Section 21 / A of the Corm. Decree.
