Procurement of mobile phones (MTEL26)

The verification of compliance with the eligibility criterion shall be carried out in a circle of AK 2: prior: based on the EEKD; ex post: on the basis of the evidence submitted by the economic operator (s) called pursuant to Article Kbt.69 (4) to (7). Preliminary attestation: The applicant and the economic operator involved in the verification of competence shall provide prior proof of compliance with the eligibility criteria by submitting the EEKD pursuant to Article 5 (1) of the KR.

The applicant shall accept a simple declaration by an economic operator in order to demonstrate the suitability requirements in advance pursuant to Article § 2 (5) of the KR by sufficient economic operator to complete Section α (alpha) of Part IV of the EEKD. Attention is drawn to the provisions of § 3 KR. Subsequent attestation: The certificates provided for below must be submitted only to the requested tenderer by way of an invitation pursuant to Article 69 (4) AK Kbt. M.1.

The contracting authority shall attach (or, in the case of the capacity of another organisation, the capacity-providing organisation) a reference certificate or declaration for the most significant deliveries within the meaning of Article 22 (1) of the Kr. 21 (1) (a) for a period of 3 years (36 months) from the date of dispatch of the call but not exceeding 6 years (72 months).

The certificate or the declaration shall contain at least the following particulars: the name of the other party to the contract, the contact details of the contact point of the contract; the subject-matter of the transport in such detail that compliance with the eligibility requirements can be clearly established; the net amount of the remuneration; the date of performance (i.e. the date of commencement and successful completion broken down by year, month and day); and a declaration as to whether the performance has been carried out in accordance with the requirements and the contract.

Where the performance has not been carried out in accordance with the contract, the reasons and the extent of the derogation in the certificate or declaration and, in the event of a breach of the contract, the fact that the economic operator is liable for breach of contract shall be explained.

Where the proof of suitability is made by a procuring entity or another organisation involved in the verification of the suitability, the declaration shall also state whether the other party to the contract disputes the nature of the performance contract or, where the economic operator has declared that there is no liability of the economic operator for breach of contract.

The applicant points out that, in the case of joint performance (where applicable, consortium), only the work carried out by an economic operator wishing to demonstrate its suitability will be taken into account for the reference presented. In addition, the verification of competence is governed by § 65 (6), (7), (9) and (11) of Kbt, § 67 (3) Kbt, § 69 (11a) Kbt, § 1 (7), Article 21 / A and Article 24 (1) of Kr. The required competence requirements may be met by joint Contracting Parties.

The applicant shall act on the certificate of technical competence on the basis of Articles Kbt.65, 67 and 69 and § 21 KR. Minimum eligibility requirement (s): M.1. Unqualified tenderer (joint AT) if it does not present a reference (s) for the carriage of mobile telephone devices of a value of at least HUF 200.000.000 net within 3 years (36 months) from the date of dispatch of AF (i.e. closed by delivery) but up to 6 years (72 months). The reference may be presented from the performance of several contracts.

For the purpose of fulfilling the reference to be presented, the Contracting Parties shall be informed of the provisions of § 21 (1a) (a) Kr. The applicant does not apply § 21 (1b) Kr.
