Procurement of RPA software implementation services - Robotic Process Automation and AI

Economic operators submitting tenders must prove a form of registration under the law of the resident country showing that the economic operator is legally constituted, that he is not in any of the situations of cancellation of the constitution, and that he has the professional ability to carry out the activities covered by the public / sectoral contract. Method of implementation: The DUAE will be supplemented by economic operators participating in the procurement / sectoral procedure with the information requested by the contracting authority / entity - information on the fulfilment of the requirements for the employability. The supporting document proving the fulfilment of those assumed by the completion of the DUAE, i.e. the finding certificate issued by the ONRC, or in the case of foreign legal / natural bidders, the equivalent documents issued in the country of residence, translated into Romanian, are to be submitted, at the request of the contracting authority / entity, only by the highest bidder in the intermediate ranking drawn up on completion of the evaluation of tenders.

Its annual average turnover in the area covered by the contract for the number of years specified in the relevant notice, in the procurement documents: The minimum annual average turnover of the last three years (2023, 2024, 2025) shall be at least equal to 3.750.992,22 lei. Method of implementation: In order to meet the requirement, the DUAE will be completed by the economic operators (Single Tender / Associated Tender / Supplying Third Party) participating in the award procedure. The following information shall be specified by the tenderers at DUAE level: - Average annual turnover for the last 3 financial years (2023, 2024, 2025). The supporting documents demonstrating the support of the information, valid at the time of its submission, shall be requested by the contracting authority of the successful tenderer first after applying the award criterion to admissible tenders prior to the award of the contract. It may, but not limited to, submit the balance sheets for the last 3 years (2023, 2024, 2025), resulting in the annual turnover (covered and recorded by the competent bodies), or other accounting documents provided that they contain the relevant information by which the tenderer proposes its economic and financial capacity. These documents shall be submitted by the tenderer as well as by all members of the association and supporting third parties, as appropriate, on whose capacity they rely on to meet the requirement. For non-resident (foreign) economic operators, equivalent documents from the country of origin will be presented, showing the requested information, accompanied by their authorised translation into Romanian. For the calculation of the equivalence of the turnover qualification requirement, for a uniform assessment of how it is fulfilled, the average annual rate of MDL / currency communicated by the NBR shall apply for each of the 3 years. Note: 1. If a group of economic operators submits a joint offer, the requirement can be demonstrated by taking into account the resources of all members of the group. In this case, the associated tenderer will also complement the DUAE. 2. In order to fulfil the requirement, the tenderer may benefit from the support of a third party / third party. Article 182 of Law No 98 / 2016 and Article 48 of GD No 395 / 2016 will be complied with. Where the tenderer is an association or is supported by one or more supporting third parties, the requirement shall be deemed to be met by summing up the annual turnover of all members of the association and / or the third party (s) supporting financial support, as appropriate, for that year. 3. If the tenderer receives support from a third party, the supporting third party shall complete the DUAE. The contracting authority will reject the proposed supporting third party if it does not meet the capacity qualification requirements, or is in any of the grounds for exclusion. The supporting documents, which propose the fulfilment of those assumed by the completion of the DUAE pursuant to Article 193 (1) of Law 98 / 2016, shall be submitted, at the request of the contracting authority, only by the highest bidder following the ranking drawn up on completion of the evaluation of tenders. 4. For the equivalence of the turnover qualification requirement, for a uniform assessment of how it is fulfilled, the average annual rate of MDL / foreign currency communicated by the NBR shall apply for each of the 3 years.

The tenderer must prove that in the last 3 years, calculated retroactively from the deadline set for the submission of tenders, it has successfully completed contracts of a nature and complexity similar/comparable to the specific nature of the contract / operations of the type specified in the subject matter of the contract, with a cumulative value of at least RON 1,875,496.11 excluding VAT, across a MAXIMUM of 5 contracts. Contracts of a nature and complexity similar/comparable to the specific nature of the contract are understood to have had as their subject the supply and/or implementation of AI/chatbot/NLP-based software solutions and/or the economic operator implemented RPA (Robotic Process Automation) software solutions. In the event that the contracting entity opts to calculate the reporting period for similar experience in accordance with the provisions of Art. 13 para. (1) let. b) of ANAP Instruction no. 2/2017, but is required, regardless of the reasons, to postpone the deadline set for the submission of applications/tenders by publishing a corrigendum to this effect, the lower limit of the 3-year period is extended by the period of time corresponding to the postponement, and the requirement shall be deemed fulfilled for all operators who provided proof of completion of the similar experience contract within the newly resulting timeframe. Note 1: If a group of economic operators submits a joint tender, the requirement is demonstrated by taking into account the resources of all members of the group. Note 2: In order to fulfill the requirement, the tenderer may rely on the support of one or more third parties. In this regard, the provisions of Art. 182 of Law no. 98/2016 and Art. 48 of GD no. 395/2016 shall be complied with. Note 3: For conversion into RON, the average exchange rate for the years shall be used: 2023 – 1 EUR = 4.9465 RON, 2024 – 1 EUR = 4.9746 RON, 2025 – 1 EUR = 5.0415 RON. Method of fulfillment: The tenderer ranked first after applying the award criterion shall submit, prior to the award of the contract, upon request of the Contracting Authority, certificates/documents attesting the fulfillment of the requirement, namely: documents/recommendations issued by the Final Beneficiary and/or Final Acceptance Minutes and/or Assessment Documents / Performance Certificates issued by contracting authorities and/or Good Execution Certifications, showing all elements necessary to confirm the fulfillment of the technical capacity requirement. These documents shall also be submitted by the Associated Tenderer, where its resources were taken into account for fulfilling the requirement. Note 1: The Contracting Authority reserves the right to contact the final beneficiary to confirm the similar experience presented by the tenderer in the ESPD. Note 2: If relying on support from a third party, the tenderer shall submit: a) The firm commitment regarding the technical capacity support provided by the supporting third party. The firm commitment shall be uploaded to SEAP together with the tender and shall be signed with an extended electronic signature, in accordance with the law. b) The documents transmitted to the tenderer by the supporting third party/parties, evidencing the actual manner in which the supporting third party/parties will ensure the fulfillment of its/their own support commitment, which constitute annexes to the firm commitment. The submitted documents must specifically indicate the resources (material/human/technical/etc.) that the third party will mobilize if the tenderer encounters difficulties during the performance of the contract or becomes unable to perform the contract, the type of these documents being determined by the obligations undertaken by the tenderer and the supporting third party through the firm commitment.
