Provision of data transmission and internet traffic, construction and maintenance of a virtual private network (VPN) for the needs of the Executive Agency Automobile Administration

The participant shall be authorised to use a radio frequency spectrum for a terrestrial network allowing the provision of electronic communications services and to be entered in the register of persons who have notified the Communications Regulation Commission of their intention to provide public electronic communications networks or services or equivalent document. Compliance with the requirement shall be declared with the completion of Section A of Part IV of the EEDOP.

If the relevant documents are available in electronic format, indicate: web address, authority or service issuing the document, accurate reference to the document. To demonstrate compliance with the minimum requirement, the contracting authority may request from the participant additionally at any time after opening the tenders, under the conditions of Art. 67, para. 5 of the Public Procurement Act, by which the information specified in the EEDOP is demonstrated.

Prior to the conclusion of a contract, the contracting authority shall request from the participant designated as a contractor a certified copy of a permission to use a radio frequency spectrum for a terrestrial network allowing the provision of electronic communications services. The contracting authority shall not require the submission of a certified copy of the document where the authorisation information is available through a public free register.

The participant must have made registration as a local Internet Provider (IR) in RIPE or equivalent. Compliance with the requirement shall be declared with the completion of Section A of Part IV of the EEDOP. If the relevant documents are available in electronic format, indicate: web address, authority or service issuing the document, accurate reference to the document.

To demonstrate compliance with the minimum requirement, the contracting authority may request from the participant additionally at any time after opening the tenders, under the conditions of Art. 67, para. 5 of the Public Procurement Act, by which the information specified in the EEDOP is demonstrated. Before entering into a contract, the contracting authority shall request from the participant designated as contractor a document certifying registration as a local Internet Provider (IR) in RIPE.

The contracting authority shall not require the submission of the document where the information is available through a public free register.

The contracting authority shall not set requirements for economic and financial conditions in the procurement.

The participant should have carried out an activity with an object and volume identical to or similar to the object of the contract for the last 3 (three) years from the date of submission of the tender (Art. 63, para 1, item 1 For similar activities, activities involving the provision of data and internet traffic services, construction and/or maintenance of a virtual private network (VPN) are understood with the subject and volume of the contract.

Minimum requirement: For the last 3 years from the date of submission of the tender in this procedure, the participant has completed a minimum of 1 (one) service which is identical or similar to the subject-matter and volume of the contract, with a total volume of all services of minimum 1 (one) data and internet traffic, construction and/or maintenance of a virtual private network (VPN) of at least 20 (twenty) sites.

When submitting a tender, participants shall declare compliance with this selection criterion only by filling in the relevant section in the EEDOP Part IV: Selection criteria, Section C. The documents can also be requested under the conditions of Art. 67, para. 5 of the Law. If the participant has also designated subcontractors, they shall meet the relevant selection criteria according to the type and proportion of the contract they will perform.

Evidence documents: For proof of the above circumstance, according to Art. 64, para 1, item 2 and Art. 112, para 1, item 2 of the Public Procurement Act, the participants should submit before signing a contract. List of services identical to or similar to the subject-matter of the contract with an indication of the values, dates and recipients, together with documents demonstrating the service performed.

The participant shall implement an EN ISO 9001:2015 quality management system or equivalent with a range of activities involving the provision of data and internet traffic services and/or the maintenance of a virtual private network (VPN) or equivalent. Minimum requirement: The participant should apply a quality management system with a range of activities involving the provision of data and internet traffic services and/or the maintenance of a virtual private network (VPN) or equivalent.

The certificate must be issued by independent persons according to Art. 64, para. 5 of the Public Procurement Act. Compliance with the requirement is declared in Part IV: The documents can also be requested under the conditions of Art. 67, para. 5 of the Law.

Evidence documents: For proof of the above circumstance, according to Art. 64, para 1, item 10 of the Public Procurement Act and Art. 112, para 1, item 2 of the Public Procurement Act, the participant appointed as contractor shall submit before the conclusion of a contract for the contract a certified copy of a valid certificate certifying that the participant applies a quality management system under BDS EN ISO 9001:2015 or equivalent, with a range of activities involving the provision of data and internet traffic services and/or the maintenance of a virtual private network (VPN) or equivalent. Documents for proof of compliance with the requirement are valid certificates issued under Art. 64, para. 5 of the Act.
