According to Article 101(4) of the Law of 11 September 2019. Public procurement law (i.e. Journal of Laws of 2026 item 793 as amended) When describing the subject matter of the contract by reference to standards, technical assessments, technical specifications and technical reference systems referred to in Article 101(1)(2) and (3) of the PPO, the contracting authority shall allow equivalent solutions as described in the procurement documentation.
An economic operator who cites equivalent solutions described by the Contracting Authority shall demonstrate that the supplies or services offered by the Contracting Authority comply with the requirements laid down by the Contracting Authority.
