Purchase of the service for establishing and maintaining Internet connections for the ZUS

The Contractor shall comply with the condition that it demonstrates that it carries out telecommunications activities concerning the subject matter of the contract on the basis of an entry in the Register of Telecommunications Entrepreneurs referred to in Article 10(1) of the Act of 16.07.2004. Telecommunications Law (i.e. OJ 2024 item 34, as amended), led by the President of the Office of Electronic Communications.

Note 1: In the case of Contractors jointly applying for a contract, each Contractor who will perform a contract in the field of services which require registration in the Register of Telecommunications Entrepreneurs in accordance with the Act of 16.07.2004. Telecommunications law (i.e. Dz.U. 2024 item 34 as amended) must be entered in the Register of Telecommunications Entrepreneurs.

To confirm compliance with the condition of participation in the procedure, the Contractor shall submit a confirmation of entry in the register of regulated activities, i.e. a certificate of entry in the Register of Telecommunications Entrepreneurs referred to in Article 10(1) of the Act of 16.07.2004. Telecommunications law (i.e. Dz. U. 2024 item 34 as amended), confirming the operation of the subject of the order.

The Contracting Authority shall consider the condition to be fulfilled if the Contractor demonstrates that during the last 3 years before the deadline for the submission of tenders, and if the duration of the business is shorter, during that period he has duly performed or has duly performed the maintenance service of the Internet Connections, together with the protection of anti-ddos on a continuous basis for a period of at least 12 consecutive months, under one contract for a total amount of at least PLN 1 000 000,00 gross over a period of 12 months Note 1: In the case of a contract to confirm the above condition, which also included the execution of other benefits, The Contracting Authority requires that the maintenance service of the Internet connection, together with anti-ddos protection, be performed continuously for at least 12 months at a minimum of PLN 1 000 000,00 gross.

Note 2: The Contracting Authority shall recognise the service provided for a full 12 consecutive months, e.g. from 1 February to 31 January of the following year. Note 3: If the Contractor uses the experience acquired on the basis of services provided in the consortium, then the Contractor may rely on the provision of such a service if it has actually and specifically participated in its implementation.

Note 4: With regard to the conditions relating to experience, Contractors jointly applying for the award of contracts may rely on the capacity of those Contractors who have provided services to which those capacities are required. Note 5: In the case of Contractors jointly applying for a contract, the condition of participation in the procedure shall be deemed to be fulfilled if the condition is fulfilled in full by at least one of the Contractors jointly applying for a contract.

Note 6: Where the Contractor is to confirm compliance with the condition of participation in the procedure referred to in point 4.1.1.4. the capacity of other entities, the condition must meet a minimum of one of those entities.

In order to confirm compliance with the condition of participation in the proceedings, the Contractor shall submit a list of services performed or performed during the last 3 years before the closing date for the submission of tenders and, if the duration of the activity is shorter, during that period, in accordance with the model constituting the Annex No 6 to the WWZ and the addition of evidence to determine whether these services have been performed or are properly performed; the evidence in question shall be references or other documents drawn up by the entity for which the services have been performed or are duly performed, and if the contractor, for reasons beyond his control, is unable to obtain these documents - the contractor's statement
