Self-declaration on registration entries (form EKVG011). proof of registration in a professional or commercial register of the State of establishment, insofar as there is a duty to register there; otherwise, a comparable proof of the permitted occupation. In order to demonstrate the applicant’s required technical and professional capacity, the following documents must be provided: self-declaration (EKVG013) that supplies and services comparable to the subject-matter of the contract have been properly provided in the last up to three calendar years [exclusion criterion].

In particular, projects for the delivery and implementation of highly available virtualization or HCI infrastructures, including cluster configuration and migration of productive virtual systems, are comparable. At least three comparable references shall be provided with the following information: contracting entities; the nature and extent of the service performed; the period of execution; the key wording of the relevant range of services provided by own staff; appropriate contact point.

Indication of the technical specialists for project management, implementation and migration, including their respective tasks, professional experience and contract-related qualifications. At least two of the employed professionals must have up-to-date relevant knowledge in Microsoft hybrid infrastructures, proven in particular by the Microsoft Certified: Windows Server Hybrid Administrator Associate certification or an equivalent qualification.

Information must be provided on the basis of the declaration in EKVG011 that the services in question are carried out with permanent staff in their own company and that the employees necessary for the performance of the services are available. The Special Contract Conditions for the Promotion of Women (according to Wirt-2141) must be filled in with an offer and also become part of the contract.

With the offer, the bidder declares * that he will comply with the obligations acc. § 4 FFV agrees * that he observes the applicable equal treatment law, * that, if he makes use of a subcontractor or subcontractor for the performance of the contract, he ensures that the subcontractors or subcontractors comply with § 3 FFV for the implementation of measures acc. § 2 FFV and agree to comply with the obligations under § 4 FFV.

Self-declaration of the total turnover and turnover in the field of activity of the contract for the last three financial years, where available. A certain minimum turnover is not required.

The contracted bidder must have company liability insurance throughout the term of the contract. The company liability insurance must cover the following minimum sums for a double maximization per claim per year: personal injury EUR 2 500 000 (lump-sum); property damage EUR 2 500 000 (lump sum); Property damage EUR 2 500 000 (lump sum).

The bidders have to comply with the obligations to pay certain minimum hourly fees, collective agreement fees according to § 9 Abs. 1 Berlin Tendering and Procurement Act (BerlAVG) and the minimum requirements according to ILO core labour standards on the basis of the self-declaration (form EKVG015) and the obligation to pass on this obligation to subcontractors (form EKVG015). Participants in candidate/tendering communities shall fulfil the same formal conditions for each participant. Declaration (ECVG011) that the obligation to pay taxes and social security contributions, insofar as the obligation to pay contributions exists, is duly fulfilled.

Information shall be provided as to whether it is intended to cooperate with others in relation to the contract, or Subcontracts related also to parts of the service (Host-235, Wirt-236). The list of subcontractors, the self-declaration suitability (EKVG011) on the part of the subcontractor with references (EKVG013), the declaration of commitments for partial services by subcontractors (Form Wirt-236) are to be submitted with the offer, if applicable.

The customer reserves the right to have self-declarations proven by corresponding proof of third parties. This also applies to proof of technical and professional capacity as well as economic and financial capacity.

If services are offered by a group of bidders, complete the form Wirt-238 (according to the declaration of the group of bidders/working groups) attached to the procurement documents, which indicates the members of the group of bidders, the intention of their association to form a jointly and severally liable group in the case of a contract and the authorised representative (lead).

In the case of a grouping of tenderers, the required documents (unless otherwise indicated) must be provided by each member of the grouping of tenderers when submitting a tender. This also applies if these services are to be provided by a subcontractor.

In the case of use of a subcontractor, the candidate submitting a tender for the services of simple subcontractors must provide declarations of commitment (host-236) for partial services of the named subcontractors that they are ready to perform the services in the case of a contract. The undertaking (Wirt-236) must be submitted with the offer in the case of the qualifying loan.

Unauthorised subcontracting by the tenderer contracted in the context of the procurement procedure may lead to termination of the contract and, where applicable, to a penalty. Where a tenderer intends to rely on the capacities of other undertakings to demonstrate its economic, financial, technical or professional capacity, it shall appoint those undertakings and the capacity used and demonstrate that the necessary means for the performance of the contract are effectively at its disposal.

For undertakings whose capacity is used, the relevant evidence of suitability and declarations of absence of exclusion shall be provided. All procurement documents are the basis of the tender and become part of the contract when the contract is awarded.

Proof from the Windows Server Catalog that the hardware server models offered are fully certified for Microsoft Windows Server 2025 / Storage Spaces Direct (S2D)

The contractor undertakes to comply with the current IT basic protection catalogues of the Federal Office for Information Security (BSI) when implementing and configuring the Hyper-V/S2D cluster. Since there is potentially access to personal data in the context of the migration of the virtual machines, an agreement for order processing (AVV) according to art is mandatory. 28 GDPR to be signed before the start of the contract.

Final assembly and system integration shall be carried out in a controlled, documented and unauthorised environment. Upon request, the supplier shall provide appropriate proof of quality assurance, supply chain safety, tamper protection and traceability of the installed components.
