Economic operators submitting tenders must prove a form of registration under the law of the country of residence, show that the economic operator is legally constituted, that he is not in any of the situations of annulment of the constitution and that he has the professional ability to perform the activities covered by the contract. Method of fulfilment and applicability within the procedure: The DUAE shall be completed by each entity that participates with or is included in the tender. Documentary evidence: At the request of the contracting authority, the tenderer ranked first following the ranking drawn up by the evaluation committee shall be required to submit the following supporting documents proving the fulfilment of those assumed by the completion of the DUAE for each entity participating in the tender or included in the tender: - for the Romanian economic operator, a certificate issued by the Trade Register Office of the competent territorial court. From the certificate / extract from the register, presented, must result: a) the main activity object and the secondary activity objects. The subject matter of the contract must have a corresponding in the authorised CAEN code of the economic operator. b) the legal situation of the tenderer and his condition; c) the legal representatives the information contained in this document must be real / actual at the time of presentation. - for foreign economic operator: the tenderer will present edifying documents, translated into Romanian by an authorized translator, real / actual at the time of presentation, which will prove a form of registration as a physical / legal person or of registration / attestation or membership from a professional point of view and in which to mention persons representing the entity in relations with third parties, in accordance with the legal provisions of the country in which the tenderer resides. The documents submitted must also include information on the tender status. NOTE: With DUAE, each entity participating in the respective tendering procedure, the associate tenderer shall submit the self-declaration on non-compliance with Article 5k of Regulation (EU) 2022 / 576 (Form No 2 of the "Forms' section)

Tenderers must provide proof of the supply under maximum 3 contracts of similar products worth 11,000,000 lei without VAT. Similar products mean the supply and entry into service of processing equipment - servers. It is requested to indicate the main supplies of products in the last 3 years, indicating the values, the supply data, the beneficiaries of those services. Method of fulfilment and applicability within the procedure: The DUAE shall be supplemented with information on contracts or parts of contracts (or other legal commitments) executed during that period, indicating their products, value and beneficiaries. In the framework of the DUAE, the information will be presented in detail so that it can be verified that the requirements in terms of period, product similarity, are met. Documentary evidence: The supporting documents are to be submitted at the request of the contracting authority, only by the highest bidder following the application of the award criterion. The documents by which economic operators can demonstrate the fulfilment of the requirement for similar experience may be the following, not limited to: recommendations / verbal reception procedures (dated and signed by the beneficiary) / finding certificates or other documents issued or countersigned by contracting authorities or private customers, confirming the similar experience requested.

In accordance with Article 3 (1) (y), any economic operator which is not part of a public procurement contract and performs certain parts or elements of the works / services, responsible to the contractor for the organisation and conduct of all the steps necessary for that purpose. The provision of equipment or the supply of materials / goods under a public procurement contract shall not be considered as subcontracting for the purposes of this Law; According to legal provisions, the supply activity cannot be subcontracted. It will be completed only in the case of services related to the main supply activity intended to be subcontracted, the tenderer to specify the part / parts of the contract he intends to subcontract, the percentage of the contract corresponding to the activities to be carried out by the subcontractor, for each subcontractor as well as the identification data of the subcontractors (at least name, legal form - SRL, SA etc., and unique registration code - CUI).
