Economic operators submitting tenders must prove a form of registration under the law of the resident country showing that the economic operator is legally constituted, that he is not in any of the situations of cancellation of the constitution, and that he has the professional ability to carry out the activities covered by the public / sectoral contract.

The requirement shall also apply to subcontractors for the part of the contract they are to undertake, which will complement the information related to their situation at the level of a separate DUAE. The subject matter of the contract must be corresponding in the CAEN code (activity authorised in accordance with Article 15 of Law 359 / 2004, as amended and completed) of the established certificate of the tenderer / leader and members of the association / subcontractors.

Method of implementation: The DUAE will be supplemented by economic operators participating in the procurement / sectoral procedure with the information requested by the contracting authority / entity - information on the fulfilment of the requirements for the employability.

The supporting document proving the fulfilment of those assumed by the completion of the DUAE, i.e. the finding certificate issued by the ONRC, or in the case of foreign legal / physical bidders, the equivalent documents issued in the country of residence, translated into Romanian, are to be submitted, at the request of the contracting authority / entity, only by the highest bidder in the ranking drawn up after application of the award criterion / by the selected bidders to sign the framework agreement or, where appropriate, admitted to participate in the dynamic public procurement system.

In the event that parts of the contract are executed by subcontractors, proof of registration and correspondence of the principal / secondary activities within the contract with the object of the acquisition shall also be submitted by subcontractors for the part of the contract they will perform. In the case of an association, each associate shall submit the necessary documents to demonstrate that it is authorised to carry out its part of the contract.

In the case of foreign legal entities, equivalent documents issued in the country of residence shall be required, in accordance with the law of the country of residence thereof, together with their translation by an authorised translator in Romanian. The purpose of the requirement is to confirm that the tenderer is not in any of the situations of annulment of its constitution and that it has the professional capacity to carry out the activities covered by the contract.

The subject matter of the contract must have a corresponding in the CAEN code of the established certificate of the tenderer / leader and members of the association / subcontractors. Method of implementation: The tenderer ranked first after the award criterion will submit, prior to the award of the contract, at the request of the Contracting Authority, documents demonstrating that the requirement for similar experience such as, but not limited to, the listing is not cumulative: copies of relevant parts of the contracts they have performed / certificates of delivery / receipt / recommendations to the beneficiaries / minutes of receipt / minutes of receipt on the subject / certificates of performance / certificates of record, confirming that in the last 3 years (report on the deadline for submission of tenders) he has implemented similar projects.

The contracting authority shall have the right to address including the final beneficiary of the project covered by the contract presented as similar experience in order to confirm those submitted by the tenderer. These documents will also be submitted by the supporting associate / third party tenderer if its resources have been taken into account for the fulfilment of the requirement.

Proof of compliance with the required requirements may be furnished by the submission of one or more documents from which all the information required is derived. Where the contract / contracts presented as similar experience have been carried out in association, the amount to be taken into account for the fulfilment of the minimum requirement shall be calculated in accordance with the percentage laid down in the association contract.
