Economic operators and subcontractors submitting tenders must prove a form of registration under the law of the country of residence, show that the economic operator is legally constituted, that he is not in any of the situations of cancellation of the constitution, and that he has the professional ability to carry out the activities covered by the contract or part of the contract that they are to perform for subcontractors. Method of implementation: The DUAE shall be supplemented by the economic operators participating in the award procedure with the information requested by the contracting authority - information on the fulfilment of the requirements for the ability to pursue the professional activity. The supporting document proving the fulfilment of those assumed by the completion of the DUAE, i.e. the finding certificate issued by the National Trade Registry Office - the subject matter of the contract must have the corresponding in the CAEN code of the certificate or in the case of foreign bidders, equivalent documents issued in the country of residence, translated into Romanian, valid at the time of submission, and shall be submitted, at the request of the contracting authority, only by the highest bidder in the intermediate ranking drawn up on completion of the tender evaluation.

The part / parts of the contract that the economic operator intends to subcontract pursuant to Article 179 (k) of Law No 98 / 2016 on public procurement, as amended and supplemented. Method of implementation: The DUAE shall be completed by the economic operators participating in the award procedure with the information related to their situation, in accordance with Article 193 (1) of Law No 98 / 2016 on public procurement, with subsequent amendments and additions. The supporting documents proving the fulfilment of those assumed by the completion of the DUAE shall be submitted, at the request of the contracting authority, only by the tenderer ranked 1st in the intermediate ranking drawn up on completion of the evaluation of tenders. In establishing the qualification criteria, it was intended to be objective, non-discriminatory, proportionate to the complexity and subject matter of the contract and to reflect the concrete possibility of economic operators to fulfil the contract. I also consider that they do not lead to restrictions on participation in the award procedure and are not disproportionate to the nature and complexity of the contract to be awarded.
