Subscription support, consulting and provision of licensing rights for a specialized software product for the needs of UMBAL 'Alexandrovska' EAD

Subscription maintenance, update, and servicing of software products constituting the hospital information system. Provision of consultations and services, troubleshooting, provision of all modified and additional versions of the software product, organization of database archiving, and all other actions of the contractor necessary for the normal operation of the software product, as well as the acquisition of license rights.

The following software products per workstation are subject to maintenance: Gama Codemaster – 430 units; Gama Calc – 1 unit; Gama Cont – 15; Gama Multilab – 46 units; Gama Multilab-KAAV – 4 units; Gama Store – 35 units; Gama Store-verification – 1 unit; Gama mStore (mStore) – 2 units; Gama Anketi – 1 unit; Gama SESPA Link – 1 unit; Gama FU Link – 10 units; Gama Admin – 1 unit; Gama Konkurent – 1 unit; Gama Dieti – 1 unit; Gama Store Link – 1 unit; Gama mDOCTOR – 2 units; Gama LIS link (connection to external LIS) – 2 units; Connection to PACS – 1 unit.

The contract enters into force from the date of its conclusion and has a validity term of 12 (twelve) months. The participant must be granted rights by the copyright holder of the software products – a contract, declaration, or other document originating from the author of the system establishing duly granted rights to perform the activities within the scope of the procurement for the envisaged 12-month period.

Subscription maintenance must include updates to the software products, the provision of consultations, and services related to their use, as follows: a/ Consultations and assistance in the operation of the Software Products used by the Contracting Authority, which are provided remotely without on-site visits, every business day for the term of the contract from 8:30 a.m. to 5:30 p.m. (working hours); b/ Elimination of hidden program errors (BUGS) and, if necessary, database malfunctions resulting from them; c/ Provision of modified and supplemented versions (updates) of the system and descriptions of changes in the existing functionalities of the Software Products used, by publishing them on the CONTRACTOR's website so that they are accessible to the Contracting Authority. These activities are carried out upon the request of the Contracting Authority in connection with:

• Inaccuracies (software bugs) detected by the Contracting Authority in the operation of the Software Products used;
• Requirements of statutory and regulatory enactments, the National Framework Agreement (NFA), and other decisions and instructions of competent authorities, the implementation of which requires non-essential modifications to already existing functionalities of the Software Products used. Outside the scope of the activity under this paragraph are requirements that necessitate essential modifications to the existing functionalities of the Software Products, such as, but not limited to
• new integrations for data exchange with systems at the local, regional, national, or European level, changes including expanding the type of exchanged data, new electronic formats, new coding systems, nomenclatures, and classifications for coding exchanged data, new standards and protocols for data exchange, introduction of new reporting regimes, change in the cycle/frequency of information exchange, and others, as well as the development of new functions;d/ Provision of modified and supplemented versions (updates) of the system and descriptions of changes in the existing functionalities of the Software Products used, in connection with improvements in the performance of the Software Products, including functionality enhancements introduced on the unilateral initiative of the CONTRACTOR, by publishing them on the CONTRACTOR's website so that they are accessible to the Contracting Authority;e/ Verification of the existence of a regular database backup process for the Software Products maintained by the Contracting Authority (without examining its completeness, structure, and integrity)…
