Ponuditelj u sklopu svoje ponude kao jamstvo za ozbiljnost ponude dostavlja bankarsku garanciju.
Bankarska garancija mora biti neopoziva, plativa na prvi poziv, bez prava prigovora (protesta) i bezuvjetna. Jamstvo za ozbiljnost ponude mora glasiti na Naručitelja (HRVATSKA ELEKTROPRIVREDA – dioničko društvo, Ulica grada Vukovara 37, 10000 ZAGREB, OIB: 28921978587).
U slučaju dostave ponude zajednice gospodarskih subjekata, prihvatljivo jamstvo za ozbiljnost ponude može za ponuditelja dati bilo koji član zajednice na ukupno traženi iznos ili neki ili svi članovi zajednice sveukupno do ukupno traženog iznosa.
U slučaju podnošenja zajedničke ponude jamstvo za ozbiljnost ponude treba sadržavati jasan i nedvosmislen navod o tome tko je ponuditelj. U jamstvu za ozbiljnost ponude trebaju se nalaziti podaci o svim članovima zajednice gospodarskih subjekata bez obzira na to koji od članova zajednice gospodarskih subjekata dostavlja jamstvo u sklopu ponude.
Trajanje jamstva ne smije biti kraće od roka valjanosti ponude. Ako se ponuditelj usuglasi sa zahtjevom Naručitelja za produženje valjanosti ponude, jamstvo za ozbiljnost ponude mora se produžiti u skladu s produženjem roka valjanosti ponude. U tu će se svrhu ponuditelju dati primjereni rok ne kraći od 5 dana.
Naručitelj može polagati pravo na iznos jamstva za ozbiljnost ponude u slučaju:
- ako ponuditelj odustane od svoje ponude u roku njezine valjanosti
- nedostavljanja ažuriranih popratnih dokumenata u skladu s člankom 263. ZJN 2016
- neprihvaćanja ispravka računske greške
- dostavljanja neistinitih podataka
- odbijanja potpisivanja okvirnog sporazuma ili nedostavljanja jamstva za uredno ispunjenje okvirnog sporazuma. U tekstu bankarske garancije treba taksativno navesti sve prethodno naznačene slučajeve za koje se izdaje jamstvo za ozbiljnost ponude.
