What the buyer wants
Videoconferencing systems are to be delivered in accordance with an EVB-IT framework agreement system delivery and EVB-IT system delivery terms and conditions and EVB-IT service. The video conferencing equipment is the procurement of video conferencing systems, which are to be operated and connected in a complex and highly available Cisco Video Meeting Server infrastructure of the client (Cisco CMS) and Expressways (Cisco VCS-E & C). Encoders from the manufacturer Cisco must be offered, which support video communication via SIP video protocol. In the case of video conferencing systems, the IMAC/R/D processes for the respective systems and support are also tendered in addition to the delivery. The contract term of the framework agreement starts with the contract, but at the earliest on 01.01.2027 and has a term of 4 years. In the case of framework agreements, the maximum value to be indicated in the EU notice shall be 150 % of the awarded contract value. This means that the customer will retrieve services from this framework agreement up to a maximum value of 150% of the total offer amount. Clients are Dataport AöR, Freie und Hansestadt Hamburg, Land Schleswig-Holstein, Land Sachsen-Anhalt.

The following minimum requirement for the economic and financial capacity of a tenderer has been established: Minimum annual turnover in the field of activity of the contract: [turnover data (eAllocation criterion 2.2.1.2)] The query of the turnover figures in the eVergabe must be answered accordingly and, in addition, in the case of a bidding group or the use of privileged subcontractors, the corresponding information in the eVergabe for the other companies. The data are checked to see whether the turnover in the field of activity of the order in the last two financial years per financial year was at least 1,800,000.00 euros net. If this information does not reach the required minimum value, a positive forecast that the tenderer has the necessary economic and financial capacity for the performance of the contract cannot be made; the offer is then necessarily excluded from the procedure. In the case of groupings of tenderers and in the case of use of privileged subcontractors, the turnover ratios of the members of the grouping of tenderers or of the privileged subcontractors and of the tenderer shall be added. The customer reserves the right to request further information or proof from a tenderer at any time in order to be able to verify his information.
The minimum economic and financial capacity of a bidder has been set as follows: [Information on business liability insurance (eProcurement criterion 2.2.1.3)] A company liability insurance with the following minimum amounts of cover is required: - 5 million. Euro for personal injury per claim for double the maximum annual performance for all claims and - 5 million. Euro for property damages per claim for double the maximum annual performance for all claims and - 2.5 million. Euro for property damages and data protection damages per claim for double the maximum annual performance for all claims. The insurance shall be maintained for the entire duration of the contract. By submitting the offer, the bidder declares in the eProcurement (in the section “Quality” under point 2.2.1.3.1 there) to submit this proof in time and without being requested. The valid proof shall be submitted within 14 days of the award at the latest. In the case of groupings of bidders, insurance cover must be available for each member. In the case of groupings of bidders, the declaration on company liability insurance shall be submitted by the leading company for the grouping of bidders. If the company liability insurance does not correspond to the required and promised amount, a positive forecast that the tenderer has the necessary economic and financial capacity to perform the contract cannot be made; the offer is then mandatory, possibly also retroactively, excluded from the procedure. The customer reserves the right to request further information or proof from a tenderer at any time in order to be able to verify his information.
The following minimum criteria for the technical and professional capacity of a tenderer have been established: references: [interpretation of the APPENDIX Reference Description and reference eAllocation criterion 2.2.2.2.1.1] At least 1 comparable reference project which has been successfully completed in the last three years (from or until the offer deadline) must be provided. For this purpose, the APPENDIX reference description must be completed in full (possibly several times for naming several reference projects) with the offer. A reference project is then comparable to the subject of the contract if it substantially corresponds to the framework conditions resulting from the specification of services (part B of the award documents) (type of service, duration of contract, technical environment, etc.). The reference must meet the following criteria (minimum reference requirements): - Criterion 1: Experience with contracting authorities - Tenderers may prove that they have worked for a contracting authority in the submitted reference project. Criterion 2: Experience with an order that is at least 25% comparable to the current order – Tenderers shall be able to demonstrate that they are able to settle a reference order of this size without disruption. The present order size may be based on the quantity or value of the contract in euro, provided that the reference contract covers IMAC services (as advertised; see Part B Description of Services) with IT hardware reference. Criterion 3: Cross-border activity – to prove that the contractor has executed cross-border orders using the same processes. A reference project is considered to be successfully completed if it ran for at least 12 months in the period from the abovementioned deadline [26.09.2023] until the end of the offer period [25.09.2026] and has now been successfully completed – i.e. not terminated prematurely. - if it has been running for at least 12 months from the abovementioned deadline [26.09.2023] until the end of the offer period [25.09.2026] and continues beyond the application period. - Projects started before the cut-off date [26.09.2023] can be considered, provided that one of the two above conditions is met. However, only the services actually provided by the bidder (or its subcontractor or the member of a candidate group) from the reference date [26.09.2023] are taken into account for the assessment of the reference. The relevant information on the services provided is therefore to be referred to the period 26.09.2023 - 25.09.2026. Note on the successfully completed reference project: The decisive factor is the end of the offer period. Should the deadlines be postponed, the end of the actual offer period always applies and the above mentioned deadlines are postponed accordingly. Note: It is not necessary that the tenderer meets the above minimum requirements (3 criteria) in 1 reference. It is also possible to provide the above minimum requirements (3 criteria) separately in different references, as long as each criterion in a reference is met. The customer reserves the right to request further information or proof from a tenderer at any time in order to be able to verify his information.
The following minimum criteria for the technical and professional capacity of a tenderer have been established: Qualified personnel [Qualified personnel details (eAlert Criterion 2.2.2.2.2)] The tenderer shall enter in the e-contract in the selection criteria section under item 2.2.2.2.2.1 e-contracting criterion ‘Qualified personnel’ the necessary information on the technical specialists. The following minimum eligibility requirement is made. The following technical specialists are to be used in connection with the provision of services: • 7 technical specialists qualified as video technicians. Part-time employees are included in the evaluation, but are converted accordingly to full-time employees. Apprentices / apprentices are not to be considered. If the information provided by the tenderer does not reach the required minimum value, a positive forecast that the tenderer has the necessary technical and professional capacity to perform the contract may not be made; the offer is then necessarily excluded from the procedure. In the case of a consortium of candidates and in the case of the use of privileged subcontractors, the qualified staff of the members of the consortium or of the privileged subcontractors and of the tenderer shall be added per financial year. In such a case, in the eProcurement section of the selection criteria under item 2.2.2.2.2.1 ‘Qualified staff’, the corresponding information is given for all members of the candidate community or for all members of the applicant group. in the case of a qualifying loan, indicate separately for the tenderer and the privileged subcontractor. The respective key figures must be preceded by the name of the respective company for an exact assignment. The customer reserves the right to request further information or proof from a tenderer at any time in order to be able to verify his information.
The following minimum criteria for the technical and professional capacity of a tenderer have been established: quality assurance measures: [Quality assurance information (eAssignment criterion 2.2.2.2.3)] [Evaluation of information on IT security (eAssignment criterion 2.2.2.2.3.1) and on quality management (eAssignment criterion 2.2.2.2.3.2) or evaluation of the facilities for quality assurance (the submission of the facilities is only required if there is no certificate, but general quality measures comparable to the standard of the certificates are implemented for all business processes). The measures shall be described in the Appendix and submitted together with the tender. In the eAssignment Criteria Quality Assurance Measures, the necessary information shall be provided or, if applicable, submit the facilities for quality management, environmental management or IT security. The “quality assurance” information is checked to see if the company has the following: - IT security: a valid certificate according to ISO 27001:2022 (or later) or equivalent or a comparable IT security management system. - Quality management: a valid certificate according to DIN EN ISO 9001:2015 (or later) or equivalent or via a comparable quality management system. In addition to the information in the eAssignment, the certificate with the offer must be submitted. In the case of consortia of bidders and in the case of use of privileged subcontractors, the information/installation/proof must be submitted by the company(s) which will perform the relevant part(s) of the service(s) for which the quality management is required. If the required certificate is not available, a positive forecast that the tenderer has the necessary technical and professional capacity for the performance of the contract cannot be made; the offer is then necessarily excluded from the procedure. The customer reserves the right to request further information or proof from a tenderer at any time in order to be able to verify his information.
