ZP/CZD/108/26 Delivery and exchange of RIS/PACS-class IT system with supply of server and storage infrastructure

1. Contractors who meet the conditions for participation in the procedure regarding the following may apply for the award of the contract: 1.1. technical or professional ability – this condition will be met by the Contractor if they demonstrate that within the last 3 years prior to the deadline for submission of tenders, and if the period of conducting business activity is shorter – within this period, they have completed or are performing at least one delivery including the implementation of an IT system of the RIS/PACS class, covering the migration of imaging data and integration with the HIS system. For the condition of participation in the procedure regarding technical or professional ability, ability levels have not been specified on the basis of executive regulations issued under the Act of 5 August 2025 on the certification of public procurement contractors (Journal of Laws of 2025, item 1235) https://www.gov.pl/web/uzp/wejscie-w-zycie-ustawy-o-certyfikacji-wykonawcow-zamowien-publicznych2 The Contracting Authority has specified the condition independently. 2. Contractors jointly applying for the award of the contract shall submit a statement indicating which deliveries will be performed by individual Contractors – in accordance with item C of the tender form constituting Annex No. 3 to the SWZ. Provision of resources 1. In order to confirm compliance with the conditions for participation in the procedure, in appropriate situations and with regard to a specific contract, or a part thereof, the Contractor may rely on the technical or professional abilities of entities providing resources, regardless of the legal nature of the legal relationships linking them with such entities. 2. A Contractor who relies on the abilities or situation of entities providing resources shall submit, along with the tender, an undertaking of the entity providing resources to make the necessary resources available to it for the purposes of performing the contract, or another subjective means of evidence confirming that the contractor, when performing the contract, will have the necessary resources of these entities at its disposal. 3. The undertaking of the entity providing resources referred to in item 2 confirms that the relationship linking the contractor with the entities providing resources guarantees actual access to these resources and specifies in particular: 1) the scope of the resources of the entity providing resources available to the contractor; 2) the manner and period of making the resources of the entity providing these resources available to the contractor and their use by the contractor in the performance of the contract; 3) whether and to what extent the entity providing resources, on whose abilities the contractor relies in relation to the conditions for participation in the procedure regarding education, professional qualifications or experience, will perform the construction works to which the indicated abilities relate. 4. The Contracting Authority assesses whether the technical or professional abilities made available to the contractor by the entities providing resources allow the contractor to demonstrate compliance with the conditions for participation in the procedure specified by the Contracting Authority, and also examines whether there are any grounds for exclusion against this entity that have been provided for with respect to the contractor. 5. If the technical or professional abilities of the entity providing resources do not confirm that the contractor meets the conditions for participation in the procedure or if grounds for exclusion apply to this entity, the Contracting Authority shall request that the contractor, within the deadline specified by the Contracting Authority, replace this entity with another entity or entities, or demonstrate that it independently meets the conditions for participation in the procedure. 6.
