A self-declaration that the economic operator holds a form of registration under the law of the country of residence is legally constituted, that he is not in any of the situations of annulment of the constitution, and that he has the professional capacity to perform the activities covered by the contract.
The DUAE will be completed in accordance with Article 193- 195 of the Law 98 / 2016 on public procurement, as amended and supplemented, and the supporting documents will be submitted only at the request of the contracting authority, before the award of the contract, to the highest bidder after the application of the award criterion (cf. Article 196 (2) of the Law 98 / 2016 on public procurement, as amended and supplemented).
Documentary evidence: finding certificate issued by the Ministry of Justice - ONRC or equivalent document for foreign bidders, containing actual and current information on the date of submission of the document. It will also be possible to prove the employability of the professional activity by submitting the finding certificate issued by the ONRC in electronic form through the InfoCert online service, having incorporated, attached or logically associated with the extended electronic signature.
Information on subcontracting (if applicable), specifying the part (s) of the contract that the economic operator intends to subcontract (subcontracting proportion).
Method of implementation: In case of subcontracting, the DUAE shall be completed in accordance with Article 193- 195 of Law 98 / 2016 by all participants and the subcontracting agreement shall be submitted, following that the supporting documents supporting those declared in the DUAE and assumed in the subcontracting agreement shall be submitted only at the request of the contracting authority, after completion of the evaluation of tenders, by the highest bidder after application of the award criterion (cf. Article 196 (2) of Law 98 / 2016 on public procurement, with subsequent amendments and additions).
