Pursuant to Section 160 of the Law against Restrictions of Competition (GWB), the request to initiate a review procedure before the Procurement Chamber is inadmissible if
- the applicant has recognized the alleged breach of procurement rules before submitting the review request and has not complained to the customer within a period of ten calendar days; the expiry of the deadline pursuant to § 134 paragraph 2 GWB shall remain unaffected,
- violations of procurement regulations, which are recognizable on the basis of the notice, shall not be reprimanded to the client at the latest until the expiry of the deadline for the application or submission of an offer specified in the notice,
- violations of procurement regulations, which are only recognizable in the award documents, shall not be reprimanded to the client at the latest until the expiry of the deadline for the application or submission of an offer,
- more than 15 calendar days have elapsed after receipt of the notification of the client not to remedy a complaint. Sentence 1 shall not apply in the case of an application for the determination of the ineffectiveness of the contract pursuant to § 135 (1) no. 2 GWB. Section 134 (1) sentence 2 GWB remains unaffected.
