Economic operators submitting tenders must prove a form of registration under the law of the resident country showing that the economic operator is legally constituted, that he is not in any of the situations of cancellation of the constitution, and that he has the professional capacity to carry out the activities covered by the framework agreement (right conferred by Article 186 (1) of L99 / 2016). Method of implementation: The DUAE shall be completed in accordance with Article 202 of Law 99 / 2016 by economic operators participating in the procedure for the award of the sectoral procurement contract with the information requested by the contracting entity - information on the fulfilment of the requirements for the ability to pursue the professional activity. The supporting document proving the fulfilment of those assumed by the completion of the DUAE, i.e. the finding certificate issued by the ONRC, or in the case of foreign legal / natural bidders, the equivalent documents issued in the country of residence, translated into Romanian, are to be submitted, at the request of the contracting entity, only by the highest bidder, in the intermediate ranking drawn up on completion of the evaluation of tenders. The documents must be valid at the date of presentation. Documents issued in other than Romanian must be accompanied by certified translations in Romanian.

Similar experience to economic operators is required / requested to demonstrate that they have delivered similar products to the contract object in the last 3 years (calculated retroactively against the deadline for submission of the offer) resulting in the fact that the tenderer has delivered products of the nature and complexity similar to the products covered by the contract / products of the type specified in the contract, at the level of one or the cumulation of the values of the products delivered in several contracts. In the event of a delay in the deadline for submission, the lower limit of the 3-year period shall be extended by the time period corresponding to the delay, to be considered to be met the requirement for all operators who have submitted proof that the similar experience contract has been concluded within the new period of time. The tenderer shall submit documents relating to similar products (supply and implementation of Call Center platforms) delivered in the last 3 years, the sum of the amounts included in these documents submitted by the economic operator as proof of his similar experience (one or more contracts / other documents issued or countersigned by a beneficiary authority or client) shall be equal to or greater than 3 000,000,00 lei without VAT a). The DUAE b) Under DUAE economic operators shall provide information on the delivery of similar products to the contract in the last 3 years c) Documents to be submitted for the proof of the goods delivered, as specified by the economic operator / tenderer in DUAE may be: contract, invoice, which shall be indicated in other document, in accordance with the recommendation. The supporting documents proving the fulfilment of those assumed by the completion of the DUAE (i.e. certificates / documents / contracts / cumulation of contracts / minutes of receipt issued or countersigned by a Contracting Entity or by the Beneficiary) shall be submitted at the request of the contracting entity, by the highest bidder, in the intermediate ranking drawn up upon completion of the evaluation of the tenders.

Certification of the implementation of the quality management system according to Romanian standard ISO 9001 or equivalent, valid at the time of presentation of the document. The economic operator will demonstrate the implementation of a quality management system in accordance with SR EN ISO 9001 or equivalent, allowing both the presentation of a certificate issued by a certification body and other documents that conclusively prove that the requirement is met. The application for an ISO 9001 certificate from participating economic operators is justified by the need to ensure an adequate level of quality control, traceability and conformity in the performance of the contract, taking into account the specific activities and legal obligations related to the sector. In sectoral procurement, products or services may have a direct impact on strategic infrastructure (energy, water, transport, utilities), which requires: reducing the risk of non-compliance, operational safety, continuity of the public service. ISO 9001 provides an objective guarantee that the economic operator has the capacity to deliver consistent and compliant results. Method of fulfilling the requirement in case of association: the requirement will be met by taking into account the resources of all members of the group. The documents submitted must be valid on the date of presentation.
