gem. Conditions of Participation No. 2 d Proof of a company liability insurance with a cover sum of at least € 3 million for personal and property damage and at least € 2 million for property damage. The above-mentioned sums of cover must apply per claim. The benefit must be maximised at least twice per insurance and per insurance year. The insurance confirmations must not be older than twelve months at the end of the offer period.

Or if this does not exist as required at the time of submission of the offer, a self-declaration by the bidder that in the case of placing the order a corresponding insurance is concluded and a confirmation by an insurer that he is willing to conclude such a company liability insurance with the bidder (copy insurance policy must be submitted until the start of the contract). Coverage must be fully maintained over the term of the contract.

In the case of a grouping of bidders, the declarations of insurance shall be attached for each member of the grouping of bidders and the full coverage shall be provided for all members.

gem. Conditions of participation No 3a Two comparable references whose services were provided in whole or in part within the three years preceding the expiry of the offer period. A reference is considered comparable if it has the following features:

• cloud-based VoIP/UCC solution or Cloud PBX/SaaS telephony in productive operation
• a reference with at least 500 users, a reference with at least 300 users
• introduction or migration including phone number acceptance/porting and SIP connection
• provision and operation of softphone/UCC functionalities
• ongoing system service/support according to agreed service levels over a period of at least twelve months.

gem. Conditions of participation No. 3 b) Appointment of a responsible project manager with proven experience in relevant projects. The role, time period and tasks in the implementation of the VoIP/UCC/cloud telephony solution are to be specified, for example on the basis of the CV. e For the project management qualifications, a valid certificate such as IPMA, PRINCE2, PMI or comparable evidence must be submitted. Required certificates shall be valid at the end of the tendering period. If the validity expires until December 2026 inclusive, a proof of the initiated recertification or Renewal submitted.

gem. Evidence of at least two technically qualified employees for implementation and support of the offered solution (name, function, professional experience, task in the project, qualifications, certificates). Manufacturer certificates can serve as proof; functionally equivalent qualifications shall be accepted.

gem. Conditions of Participation No. 3 d Proof or short description of a service organization, which can cover the service, reaction and restoration times required in the specifications organizationally and personnel.

gem. Conditions of Participation No. 3 f Proof of valid information security management by ISO/IEC 27001 or equivalent. The proof must be provided by the companies that operate the offered SaaS platform and the data centers. Its scope must include the operation of the service offered. In addition, an up-to-date BSI C5 test report or equivalent independent evidence shall be provided for the specific cloud environment in which the service is provided.

Required certificates shall be valid at the end of the tendering period. If the validity expires until December 2026 inclusive, a proof of the initiated recertification or Renewal submitted. The demonstration of an information security management according to ISO/IEC 27001 or equivalent shall be maintained throughout the term of the contract.

For qualifications of the deployed project staff, valid certification at the end of the tendering period is sufficient, provided that the nominee is deployed for the agreed project duration or replaced by equivalent qualified staff. Equivalent evidence shall only be allowed if its scope, depth of test and timeliness correspond to the abovementioned evidence. The equivalence shall be verifiable upon submission of a tender.
