Economic operators submitting the tender must prove a form of registration under the law of the country of residence, showing that the economic operator is legally constituted, that he is not in any of the situations of cancellation of the constitution, and that he has the professional ability to carry out the activities covered by the public acquisition contract. The requirement shall also apply to subcontractors for the part of the contract they are to undertake, which will complement the information related to their situation at the level of a separate DUAE. In order to demonstrate the fulfilment of the criterion of professional activity capacity, the sole bidder / associate bidder will complete the DUAE - Part "Selection criteria '- Section A. The tenderer ranked first in the intermediate ranking drawn up on completion of the evaluation of tenders shall submit, at the request of the Contracting Authority, the supporting documents proving the fulfilment of those assumed by the completion of the DUAE, namely the Certificate of Declaration issued by the Office of the Trade Register of the Territorial Court, attesting that the subject matter of the contract is related in the work of the tenderer / associate tenderer, for the part of the contract it performs. For foreign legal persons, edifying documents proving a form of registration in accordance with the legal provisions of the country in which the tenderer is established shall be submitted, showing the information requested by the Contracting Authority. The documents submitted must be real / valid on the date of their submission. Other minimum information to be found in the finding document is: - legal identification data (name, place of business, unique registration code); - main and secondary activities; - legal representatives. Note 1: In the case of an association, documents shall be submitted for each of the members of the association. In order to fulfil the requirement, it is sufficient for each member's activity to be consistent with the part of the contract it will perform. Note 2: In the event that parts of the contract are executed by subcontractors, the proof of registration and correspondence of the principal / secondary activities within the contract with the object of the acquisition shall also be submitted by subcontractors for the part of the contract they will perform.

Where the tenderer will subcontract part of the contract, the tenderer shall be required to declare in the DUAE the subcontractor / subcontractors and to complete the part "Selection criteria '- Section C - subsection" Subcontracting proportion'. Where the tenderer uses the subcontractor / subcontractors' capacities under the contract, each subcontractor will complete a separate DUAE form comprising Part "Reasons for exclusion 'and Part" Selection criteria' - Section A. If the tenderer subcontracts part of the contract, the tenderer shall submit, with the submission of the DUAE, the subcontracting agreement - Form 8. Subcontracting contracts must be consistent with the tender and will be annexes to the public contract. If the subcontracting agreement / contract is concluded in a language other than the Romanian language, an authorised translation into the Romanian language will also be submitted. The contracting authority shall require the tenderer to specify in the tender: (a) the categories of service in the contract which it intends to subcontract; (b) the percentage or value of the activities indicated in the tender as being carried out by the subcontractors; and (c) the identification data of the subcontractors proposed, if known at the time of submission of the tender. Note: The liability of the contractor with regard to the performance of the contract is not diminished if part / parts of the contract are fulfilled by subcontractors. How to meet the requirement: 1. The tenderer shall declare in the DUAE the subcontractor / subcontractors and complete the part "Selection criteria '- Section C - Subsection" Subcontracting proportion'. 2. Each subcontractor shall complete a separate DUAE form comprising Part "Reasons for Exclusion" and Part "Criteria for Selection" - Section A.3. If the tenderer subcontracts part of the contract, the tenderer shall submit, with the submission of the DUAE, the Subcontracting Agreement Form No 8. Subcontracting contracts must be consistent with the tender and will be annexes to the public contract. If the subcontracting agreement / contract is concluded in a language other than the Romanian language, its authorised translation in Romanian will also be submitted. 4. The highest bidder in the intermediate ranking drawn up on completion of the evaluation of tenders, at the request of the contracting authority, shall submit relevant documents relating to the technical and professional capacity of the proposed subcontractors with regard to the part (s) of the contract they are actually to perform. Documents in a language other than Romanian will be accompanied by authorized translation into Romanian.
