Services IT solution integrated within the Project Digital Public Services Platform for the National Anti-Doping Agency

Application no. 1 - The annual average turnover of the economic operator during the last 3 (three) financial years (2023, 2024, 2025) will be at least twice the estimated value of the contract without VAT, i.e. at least 46266743,84 lei. The required minimum level is determined with respect to the ceiling provided for in art. 175 para. (2) of Law no. 98 / 2016 and is proportional to the complexity, duration (24 months) and step payment mechanism of the contract. The equivalent of lei / other currency will be achieved at the average annual rate communicated by the National Bank of Romania for each financial year. Method of delivery: To be completed DUAE. The highest bidder in the ranking drawn up on completion of the evaluation of offers will present the balance sheets or balance sheets related to the financial years 2023, 2024 and 2025, registered with the competent bodies, financial audit reports or any other equivalent documents considered edifying by the contracting authority. Economic and financial capacity can be supported by a supporting third party, under the terms of art. 182 of Law no. 98 / 2016. In this case, the DUAE is supplemented by the supporting third party, its firm commitment, as well as the documents submitted to the tenderer by the third party resulting in the actual way of support.

For service contracts: execution of services of the specified type. The economic operator shall provide evidence that, over the last 5 (five) years, calculated from the closing date for the submission of tenders, has provided and completed or is in operation similar services, by at least 5 (five) contracts covering all the following categories: a) Integrated IT system for a public institution Implementation of a complex IT system consisting of several integrated software modules with electronic workflows and electronic document management for a public institution or organisation of comparable complexity. The individual contract value shall be at least 50% of the estimated value of the contract in MDL without VAT (RON 11.566,685,96). b) Cloud-native solution hosted in private or government cloud Design, development and commissioning of a cloud-native application, hosted in a private or government cloud infrastructure. c) Software component based on artificial intelligence or automatic learning Development and implementation of a software solution including Machine Learning components, natural language processing (NLP) or Large Language Model (LLM) models, put into production and operational use. The component must include support for the Romanian language. Validation rules: • The same contract may demonstrate the fulfilment of one or more categories of experience referred to in points (a) to (c) if the specific requirements of each category are met. • The number of separate contracts remains at least 5 (five), irrespective of whether one or more contracts simultaneously cover several categories of experience • For the category referred to in point a), at least one contract must have an individual value of at least 50% of the estimated value of the contract in MDL without VAT (RON 11.566.685,96). Method of performance: the D.U.A.E. will be completed and the list of the main services provided, accompanied by: • name and contact details of the beneficiary, for each contract invoked; • the subject matter of the contract and its value (in lei and EUR equivalent); • period of running and stage (completed / in execution); recommendation, certificate of good execution or equivalent document issued by the beneficiary, confirming the provision of services and their quality. Note: service supplies are confirmed by the presentation of certificates / documents (not limited to): contracts or copies of relevant parts of the contracts they have performed, certificates of delivery-receipt, recommendations, minutes of receipt, certificates of performance, certificates of record, issued or countersigned by an authority or by the private beneficiary. In the case of contracts in progress only the part of services provided and received up to the deadline for the submission of tenders shall be taken into account. The technical and / or professional capacity can be supported under the terms of art. 182 of Law no. 98 / 2016, through the presentation of the DUAE completed by the supporting third party, of its firm commitment resulting from the actual way of support, as well as of the documents submitted to the tenderer by the supporting third party.

The tenderer shall specify in the DUAE and in the technical proposal the part / parts of the contract that he intends to subcontract, as well as the proposed subcontractors, indicating the identification data and the percentage / value related thereto. Method of delivery: A separate DUAE shall be completed by each declared subcontractor, together with the subcontracting agreement / agreements. The highest bidder will present the supporting documents related to the proposed subcontractors, to the same extent as for the contractor, as regards the reasons for exclusion. The contracting authority may request the replacement of a subcontractor falling within the grounds of exclusion, under the terms of Articles 170- 171 and 218- 221 of Law no. 98 / 2016

The economic operator will present ISO 9001 certification - Quality management system (or equivalent certificate or other evidence of equivalent quality assurance measures), valid at the date of submission of the document, issued by a certification body accredited by a national accreditation body of EA- MLA or a similar internationally recognised body. The scope of certification shall cover the activities covered by this contract. Method of implementation: To be completed DUAE. At the request of the Contracting Authority, the tenderer ranked 1st will submit a copy of the valid certificate, accompanied, where appropriate, by the declaration by the certification body on its validity. In the case of an association, the requirement will be met by each member of the association for the part of the service it will provide. The contracting authority shall accept equivalent certificates issued by bodies established in other Member States and other evidence of equivalent quality assurance measures under Article 199 of Law No 98 / 2016.

Information and formalities necessary for assessing compliance with the requirements mentioned: Evidence will be presented of a form of registration under the conditions of the law of the country of residence, confirming that the tenderer is not in any of the situations of cancellation of his constitution, as well as that he has the professional ability to perform the activities covered by the contract, i.e. that the object of activity includes the services covered by this acquisition. Note: the document will be presented, in any form, signed with the extended electronic signature based on a qualified certificate, according to Law no. 214 / 2024 on electronic signature. The information in the submitted document must be real / valid on the date of its presentation. For foreign legal / physical persons: in the case of bidders of non-Romanian nationality, the documents mentioned will be transmitted in the language of origin, accompanied by an authorized translation of them in Romanian. Editing documents regarding the economic operator's activity object (according to art. 173 of Law no. 98 / 2016, with subsequent amendments and completions). Method of delivery: The DUAE will be completed, following that the supporting document (ONRC certificate for Romanian economic operators, i.e. equivalent document issued in the country of residence for foreign bidders) will be submitted at the request of the contracting authority by the highest bidder in the ranking drawn up on completion of the evaluation of tenders. The documents will be presented in certified translation in Romanian. Justification: According to the provisions of art. 173 of Law no. 98 / 2016, the economic operator will present relevant documents proving the form of registration and, where appropriate, of attestation or professional membership, in accordance with the legal requirements of the country in which the economic operator is established, so that The contracting authority shall ensure that a tenderer has the legal capacity to execute the public procurement contract to be awarded.
