Extension of the technical service for the Oracle software owned by the Bank Gospodarstwa Krajowego

The Contracting Authority shall inform the Contracting Authority that, when determining the conditions for participation in a technical or professional capacity procedure, it shall not apply the capacity levels laid down in the provisions issued pursuant to Article 5(4) or (5) of the Act of 5 August 2025 on the certification of public procurement contractors, hereinafter referred to as ‘uCer’, or ‘the Act on certification of public procurement contractors’, as the capacity levels have not been defined for the subject matter of this contract.

The Contracting Authority shall consider the condition to be satisfied if the Contractor demonstrates that during the last 3 (three) years before the deadline for the submission of tenders, and if the period of business is shorter - during that period, he has duly executed:

• at least 2 (two) contracts consisting in the provision of the Oracle software service (including purchase of the manufacturer's support packages), with a value of at least PLN 700 000,00 gross (say: seven hundred thousand PLN 00/100). The Contracting Authority shall inform that, where periodic or continuous benefits are the subject of the contract, not only contracts executed (i.e. completed), but also contracts performed.In such a case, the Contracting Authority shall require that part of the contract actually completed until the time limit for the submission of tenders meets the requirements laid down by the Contracting Authority in the condition.Where the value of the contract is expressed in a currency other than PLN, The contractor shall be obliged to convert it to PLN on the basis of the average exchange rate of the currency published by the NBP (as shown in Table A of the Exchange Rates of Foreign Exchange) on the day of publication of this contract in the Official Journal of the European Union.If the publication of a contract notice in the Official Journal of the European Union occurs on the day when the NBP does not publish the average rate table, the rate from the average rate table, published on the next day following the publication of the contract notice in the Official Journal of the European Union, shall be adopted.Fulfillment of the conditions for participation in the procedure should be confirmed by submission of the declarations and documents referred to in Chapter VIII of the SWZ, i.e. the list of contracts performed, and in the case of interim or continuous benefits also performed, during the last 3 years before the expiry of the time limit for the submission of tenders, and if the period of business is shorter - during that period, together with their value, the subject-matter, the dates of performance and the entities for which the contracts were carried out, and the addition of evidence to determine whether those contracts were executed or executed duly, with the evidence referred to, references or other documents drawn up by the entity for which the contracts were carried out, and in the case of recurrent or continuous benefits, and if, for a legitimate reason of objective character, they are performed, and if, for a legitimate reason of objective nature, if, they are carried out by reference or other documents drawn up by the entity in favour of which the contracts were carried out, and in the case of services for which they are repeated or continuous, and if they are carried out, and if, for a legitimate reason of objective nature The contractor is unable to obtain these documents - the Contractor's statement.In the case of recurrent or continuous benefits, references or other documents proving that they are duly implemented should be issued no earlier than 3 months before the deadline for the submission of tenders.
