What the buyer wants
- The subject matter of the contract is in particular:
- the provision of technical assistance and maintenance services for the IPPS system for the duration of the contract, as part of the basic contract;
- the provision of development services of a maximum of 1 200 Working Hours, for the duration of the contract, under the option law. The detailed description of the subject-matter of the contract shall include a model of the contract together with the annexes, which shall be annexed to the WWZ.
- Contractors in this procedure shall not divide the contract into lots or allow for the submission of partial tenders: The subject-matter of the contract, i.e. the provision of technical assistant and maintenance services to the IACSE system and development services, cannot be divided into parts for technical, purposeful and economic reasons, as it constitutes a coherent whole.The split of the contract into parts could lead to coordination difficulties, increased risk of improper provision of services and risks to the continuity of the system. The integrated nature of the system means that the provision of support services should be carried out by one entity fully responsible for the operation of the system.The lack of division into parts does not in any way restrict access to the contract for small and medium-sized enterprises, and Contractors active in the sector covered by the contract can supply all its elements. 3.The Contracting Authority does not require the performance of the contract by protected work establishments, social cooperatives or other economic operators covered by the provision of Article 94(1) of the Act.
- The Contracting Authority shall, pursuant to Article 95(1) of the Act, require the Contractor (or subcontractor) to employ persons providing a remote assistance service of the type CALL CENTER referred to in point 5 of the Annex to the Agreement. The performance of these activities involves the provision of work as defined in Article 22(1) of the Act of 26 June 1974. – Labour Code (i.e. OJ of 2025, item 277 as amended). (This requirement does not apply to bids: natural persons conducting business activities and partnerships who undertake to provide these activities to the company in person.)
- The Contracting Authority does not provide for the possibility of awarding contracts as referred to in Article 214(1)(7) of the Act.
- The Contracting Authority does not allow variants.
- The Contracting Authority does not foresee an electronic auction.
- Prior to the initiation of the procedure, the Ordering Party did not conduct preliminary market consultations.
- Contractors in this proceeding shall not require Contractors to submit the evidence in question.
- The Contracting Authority, within the limits of the provisions of Article 462 et seq. of the Act, allows the Contractor to carry out the subject of the contract using subcontractors. The contractor who intends to entrust the execution of part of the contract to subcontractors shall indicate in the tender the parts of the contract which he intends to subcontract and the names of any subcontractors, if already known.
- Reasons for applying the criterion price 80% - Quality requirements referred to in Article 246(2) of the Act, The Contracting Authority shall describe in detail in the model of the Agreement together with the Annexes.

Contractors who, in accordance with Article 57(2) of the Act, comply with the conditions for participation in a technical or professional capacity procedure, i.e. have knowledge and experience, i.e. within the last three years before the expiry of the time limit for the submission of tenders in the procedure (and if the period of business is shorter, during that period) duly completed (completed) or carry out (currently continue to carry out) at least one contract for the technical assistance service, the implementation of which lasted for a period of at least 11 months, consisting in the maintenance, management, configuration and support of an integrated IT system in schools or schools and educational establishments in which they work/work not less than 500 users in matters concerning: accounting, staff and wages and fixed resources.
Contractors who, in accordance with Article 57(2) of the Act, fulfil the conditions for participation in the procedure in the field of technical or professional capacity, i.e.: They shall have the capacity to perform the contract, i.e. a team of at least five persons who will participate in the performance of the contract, including at least:
- a person who has at least three years of professional experience in the maintenance and/or establishment of accounting systems in schools or educational establishments;
- a person who has at least three years of professional experience in maintaining and/or creating IT systems in the field of staff and pay in schools or educational establishments;
- a person who has at least three years of professional experience in the maintenance and/or establishment of IT systems for fixed assets in local organisational units;
- a person who has at least three years of professional experience in maintaining, managing and configuring Linux operating systems;
- a person who has at least three years of professional experience in maintaining, managing and configuring the environment for VMware virtualization;
- a person who has at least three years of professional experience in maintaining, managing and configuring the relational systems of the Oracle database;
- a person who has at least three years of professional experience with the practical knowledge of JAVA technology; (It is acceptable that one person be demonstrated to fulfil more than one of the conditions referred to in point 5.1.2. of the SWZ, each of which has to meet at least one of these conditions.)
