FIBER OPTIC INFRASTRUCTURE

Documents requested:

1. for Romanian legal entities: - a certificate of establishment issued by the Office of the Trade Register showing that the economic operator is subject to the production / marketing of products of the nature of those covered by this award procedure; the information contained in the certificate must be real / current at the end of the application date;
2. for foreign legal persons: - edifying documents proving a form of registration that the legal person or the registration / attestation or membership from a professional point of view, in accordance with the legal provisions of the country in which the candidate is resident and that the economic operator is subject to the production / marketing of products of the nature of those subject to this award procedure, in compliance with the provisions of Law no. 227 / 2015 (for the imposition of income from Romania by non-resident natural and legal persons); the documents shall be submitted together with their authorized translation into Romanian. Note: In the case of an association, each associate must provide the required documents.

Requested documents:

• Romanian candidates must hold a certificate, valid at the deadline for submitting applications, proving the implementation and maintenance of a quality management system according to the requirements of ISO-9001: 2015 or equivalent;
• foreign candidates who are not established in Romania must have certifications or credentials, according to ISO-9001: 2015 or equivalent, valid at the deadline for submitting applications, granted by a national or international body, recognised by an EU member country;
• the candidate shall provide a legible copy, in accordance with the original, "signed and stamped, of the certificates issued by an independent body attesting the implementation and maintenance of a quality management system in accordance with the requirements of ISO-9001: 2015 standard or equivalent and / or any other document capable of proving compliance with the specified standard or, if not following the same standard methods, the tenderer shall prove that the performance levels set by it are met;
• where the economic operator does not hold a certificate as requested, any other evidence or evidence submitted shall be accepted in so far as they can prove that the quality is ensured. Note: In the case of the submission of an application / offer in association, each associate shall be required to demonstrate that the requirement is met for the part of the contract they make. The requested documents must be valid on the deadline for submission of applications.

By similar products, the contracting authority shall only mean products delivered on the basis of contracts for the production / marketing of delivered and installed products such as active and passive equipment associated with fibre optic networks (switch, router, patch panel optic - ODF, rackes, UPPs, fibre fibre fibre, etc.), as well as fibre fibre infrastructure services / works (design, installation, welding and testing fibre optic networks). Note:

• Where technical and / or professional capacity values are expressed in other currencies, for currency / lei equivalence, the average annual foreign currency / lei exchange rate communicated by the National Bank of Romania (B.N.R.) for the years 2021, 2022, 2023, 2024, 2025 (www.bnr.ro) will be used, mentioning in the documents submitted the currency rate used (Form no. 10

  1. Statement / declarations on the list of main deliveries of similar products in the last 5 years resulting from the delivery of similar products
• Section Form I
• Form No 10 (one form for each contract will be completed according to the completion instructions in the form);
  2. The supporting documents relating to each declaration, in support of it: certificates / documents for the confirmation of deliveries / receivables (minutes of receipt of the goods, record of fulfilment of contractual obligations, recommendations from beneficiaries, any other equivalent edifying documents), issued or countersigned by a contracting authority or by beneficiary customers, from which the products delivered, their value and the date of receipt by the beneficiary are unequivocal. The supporting documents shall be presented in legible copy with the words "in accordance with the original ', signed and stamped. Note:
     1. Similar experience shall be proven by filling in and submitting a form or several forms (in accordance with the model presented in the Form
• Stage I Form No 10) and submitting supporting documents in support of those declared;
  2. The candidate's technical and professional capacity may also be supported for the performance of a contract by another person, irrespective of the nature of the legal relationship between the candidate and the person concerned, subject to the other conditions imposed by this documentation. 3. The person providing technical and professional support shall not be in the situation leading to exclusion from the award procedure, as provided for in Articles 150, 155 and 156 of O.u.G. No 114 / 2011 (the candidate shall submit Forms No 4, 5 and 7

At the same time, if the candidate demonstrates his technical and professional capacity by invoking and supporting another person, then he is required to prove the support he receives by presenting a firm commitment of that person (Section Form I - Form No 13), concluded in authentic form before a notary (according to Article 165 (2) of the GEO No 114 / 2011), confirming that he will make available to the candidate / tenderer …

Under the "restricted tender 'procedure," secret service' classified information will be circulated, which requires that, for participation in the award procedure:

1. national economic operators hold PPSIC (a plan to protect the leakage of classified information) approved under the law and an accredited CIS minimum secret service level;
2. external economic operators: b.1) must provide documentation showing the right to manage classified information of equivalent secret service level or higher, as the case may be, issued by the competent national authorities; b.2) must comply with the security measures / requirements laid down in the governmental agreements or departments of mutual protection of classified information concluded by Romania with the State in which the registered economic operator.Documents required: Interested economic operators shall be required to participate in the procedure in submitting a self-declaration showing the following information:
   • the fact that they hold an approved and approved PPSIC (the number and date of registration of the PPSIC) and the registration number and date of the endorsement address submitted by the SRI;
   • the fact that they hold an accredited SCI for the handling of minimum secret service information (number, date and validity of SCI Accreditation Certificate, number and date of PrOpSec). For this purpose, forms No 15A and 14- The Phase I Form section, supplemented by the candidate, the supporting third party (economic / financial / technical / professional) and the subcontractor, if any, and in the case of an association by all members of the association. For foreign economic operators:
   • company identification data;
   • copy of the Industrial Security Certificate (FSC
