O udzielenie zamówienia mogą ubiegać się Wykonawcy, którzy nie podlegają wykluczeniu, na zasadach określonych w Rozdziale VI SWZ, oraz spełniają określone przez Zamawiającego warunki udziału w postępowaniu. 2. O udzielenie zamówienia mogą ubiegać się Wykonawcy, którzy spełniają warunki dotyczące:

  1. zdolności do występowania w obrocie gospodarczym: Zamawiający nie stawia warunku w powyższym zakresie.
  2. uprawnień do prowadzenia określonej działalności gospodarczej lub zawodowej, o ile wynika to z odrębnych przepisów: Wykonawca spełni warunek, jeżeli będzie posiadał wpis do Rejestru przedsiębiorców telekomunikacyjnych (zgodnie z ustawą z dnia 12 lipca 2024 r. Prawo komunikacji elektronicznej (Dz. U. z 2024 r. poz. 1221 z późn. zm.) oraz złoży oświadczenie w tym zakresie zgodnie z Załącznikiem nr 3 do SWZ.
  3. sytuacji ekonomicznej lub finansowej: Zamawiający nie stawia warunku w powyższym zakresie.
  4. zdolności technicznej lub zawodowej: Zamawiający nie stawia warunku w powyższym zakresie. 3. Zamawiający, w stosunku do Wykonawców wspólnie ubiegających się o udzielenie zamówienia, w odniesieniu do warunku dotyczącego zdolności technicznej lub zawodowej dopuszcza łączne spełnianie warunku przez Wykonawców. 4.Zamawiający może na każdym etapie postępowania, uznać, że wykonawca nie posiada wymaganych zdolności, jeżeli posiadanie przez wykonawcę sprzecznych interesów, w szczególności zaangażowanie zasobów technicznych lub zawodowych wykonawcy w inne przedsięwzięcia gospodarcze wykonawcy może mieć negatywny wpływ na realizację zamówienia.

Oferta musi zawierać:

  1. Interaktywny formularz ofertowy oraz
  2. Formularz parametrów technicznych, formularz cenowy wraz z opisem przedmiotu zamówienia – wypełniony zgodnie z załączonym wzorem tj. Załączniki nr 2.1 do 2.5 do SWZ odpowiednio do zadania, na które wykonawca składa ofertę. Stanowi integralną część Interaktywnego formularza oferty. UWAGA 1: Jeżeli Wykonawca nie złoży dokumentów określonych w pkt 1) i pkt 2) wówczas oferta Wykonawcy zostanie odrzucona. Ponadto do oferty należy dołączyć:
  3. Pełnomocnictwo upoważniające do złożenia oferty, o ile ofertę składa pełnomocnik. Pełnomocnictwo jest także wymagane w przypadku reprezentowania Wykonawców wspólnie ubiegających się o udzielenie zamówienia,
  4. Oświadczenie z art. 125 ust. 1 ustawy Pzp, o którym mowa w Rozdziale VII pkt 1 SWZ,
  5. Zobowiązanie innego podmiotu, o którym mowa w Rozdziale XVI pkt 4 ppkt 1) SWZ, zgodnie z załącznikiem nr 5 do SWZ (jeśli dotyczy),
  6. Oświadczenie z art. 117 ust. 4 ustawy Pzp, o którym mowa w Rozdziale XV pkt 6 – zgodnie z załącznikiem nr 6 do SWZ (jeśli dotyczy).
