Provision of mobile telephony services and access to the Short Message Service Center system (SMS gateway)

The Contracting Authority requires that the Contractor be entered in the Register of Telecommunications Entrepreneurs conducted by the President of the Office of Electronic Communications, in the field of activity corresponding to the contract in question.

1. The Contracting Authority requires the Contractor to have its own public telecommunications network covering the telecommunications infrastructure used to provide mobile telephony services. The network at the disposal of the Contractor shall be understood by its own public telecommunications network on the basis of a right of ownership or other legal title providing Contractors are able to actually operate and use it to provide the services covered by the contract.
2. The Contracting Authority shall authorise the use by the Contractor of domestic roaming to complement its own network coverage, in particular in areas where the Contractor does not provide sufficient coverage of its own telecommunications network.
3. The possibility of providing services using other operators' telecommunications infrastructure, in particular on the basis of a national roaming agreement, resale of services or other means of using another network, is not considered to be fulfilled. The use of the infrastructure of other operators, to the extent permitted in accordance with point (b), shall not preclude the possibility of considering the condition referred to in point (a) as satisfied.
