The economic operator submitting the offer must prove a form of registration under the conditions of the law of the country of residence, is legally constituted and is not in any of the situations of cancellation of the constitution, as well as the fact that it has the professional ability to perform the activities covered by the contract. The way in which the fulfilment of the requirement can be demonstrated: a) The tenderers will complete with information related to their situation the DUAE file, which is generated and completed directly in the system. b) The supporting documents which will prove the fulfilment of those assumed by the completion of the DUAE will be submitted at the request of the contracting authority, only by the tenderers ranked in the first 3 seats after the application of the award criterion. These supporting documents are: a) The finding certificate issued by the National Trade Registry Office - signed with the extended electronic signature based on a qualified certificate issued by an accredited certification service provider. Note: In the case of foreign bidders, equivalent documents will be presented issued by the competent authorities of the country of residence - signed with the extended electronic signature based on a qualified certificate issued by an accredited certification service provider.

Information on the association/consortium (if applicable) In the case of an association/consortium of economic operators, the information shall be provided by completing the ESPD form in the procurement documentation, in accordance with the provisions of Art. 53 of Law no. 98/2016, according to their situation. Method by which fulfillment of the requirement can be demonstrated: The tenderer shall fill in the corresponding requirement in the ESPD form within the procurement documents. - The member(s) of the association (as applicable) will fill in the ESPD form with the information corresponding to his/their situation. Upon the request of the contracting authority, following the completion of the bid evaluation, tenderers whose joint tender ranked in the top 3 places in the intermediate ranking will submit the Association/Consortium Agreement, signed and stamped by each individual associate, in order to participate in the contract award procedure, in original, certified copy, or legible copy marked "certified true copy of the original", notarization not being mandatory in this regard. Upon concluding the contract, the economic operator shall submit the contracts concluded between the contractor and subcontractor/subcontractors nominated in the tender or declared subsequently, so that the activities assigned to them, as well as the amounts related to the services, are included in the public procurement contract. Subcontractors If applicable, the tenderer shall specify in the tender the part/parts of the contract that it intends to subcontract and the identification data of the proposed subcontractors (pursuant to Art. 55 para. (1) of Law no. 98/2016, as amended and supplemented). The subcontractor must not be in a situation that leads to exclusion from the award procedure according to the provisions of Art. 164, Art. 165, and Art. 167, as well as Art. 60 of Law no. 98/2016, as amended and supplemented. In accordance with the provisions of Art. 55 para. (1) of Law no. 98/2016, as amended and supplemented, subcontractors must comply with the same obligations as tenderers in the fields of environmental, social, and labor law. Method by which fulfillment of the requirement can be demonstrated: The ESPD shall be submitted by the subcontractors, if applicable, duly completed and signed by the subcontractors. The economic operator (leader, associate, third-party supporter) will fill in the corresponding requirement in the ESPD form within the procurement documents. Relevant documents from the economic operator regarding the proposed subcontractors will be submitted with respect to the part/parts of the contract that they will effectively perform (Art. 174 of Law no. 98/2016, as amended and supplemented). The documents requested in the requirement regarding the proposed subcontractors shall be submitted upon the request of the contracting authority only by the tenderers ranked in the top 3 places in the intermediate ranking. Supporting third parties In the event that the tenderer relies on the support of third parties regarding the fulfillment of criteria relating to economic and financial standing by submitting a firm commitment of support from a third party pursuant to Art. 182 of Law no. 98/2016, as amended and supplemented, it has the obligation to prove to the contracting authority that it has taken all necessary measures to have access at all times to the necessary resources invoked. Together with the firm commitment, documents demonstrating the actual manner in which the third party's support will materialize must be submitted. The person providing economic and financial support must not be in a situation that leads to exclusion from the award procedure according to the provisions of Art. 164, Art. 165, and Art. 167, as well as Art. 60 of Law no. 98/2016, as amended and supplemented.
