Economic operators submitting tenders must prove a form of registration under the law of the resident country, showing that the economic operator is legally constituted, that he is not in any of the situations of annulment of the constitution, and that he has the professional capacity to carry out the activities covered by the public contract. The requirement shall also apply to third-party supporters who supplement information related to their situation at the level of a separate DUAE. The DUAE will be supplemented by economic operators participating in the procurement procedure with the information requested by the contracting authority - information on the fulfilment of the requirements for the ability to pursue the professional activity. The supporting document proving the fulfilment of those assumed by the completion of the DUAE, i.e. the finding certificate issued by the ONRC, or in the case of bidders of foreign legal / natural persons, the equivalent documents issued in the country of residence, translated into Romanian, are to be submitted, at the request of the contracting authority, only by tenderers ranked in the top 3 places in the intermediate ranking drawn up on completion of the evaluation of tenders. Tenders submitted by economic operators shall be required to be accompanied by the DUAE form, subject to its rejection as unacceptable under Article 137 paragraph (2) letter b) of H.G. 395 / 2016.

Tenderers must demonstrate that in the last 3 years (calculated up to the closing date for the submission of tenders) they have produced similar in aggregate value of at least 350,000 lei without VAT Similar services shall mean: any provision of simulator / laboratory maintenance services. The last 3 years shall be calculated by reference to the date of submission of tenders set by the contracting authority in the contract notice (if the deadline set for submission of tenders is extended, the lower limit of the period of 3 years shall be extended by the period due to the delay, to be considered to be met by the requirement for all operators who have submitted proof of completion of similar services within the new resulting time period). The following documents will be submitted with the DUAE: the firm commitment of the supporting third party resulting from the actual way in which its support will materialise (template No 1). 3), subcontracting agreement and / or association agreement, as applicable - form 8 or form 9 - as applicable. The person providing technical capacity support must not be in the situation which determines the exclusion from the award procedure as provided for in Articles 164, 165 and 167 of Law No 98 / 2016; a separate DUAE will be completed in this respect. The DUAE shall be completed by economic operators participating in the award procedure with information describing their level of experience, by reference to contracts executed in the past, corresponding to the requirements of the contracting authority. The nominated association (s) shall present the DUAE in which the requested information will be included separately. At DUAE level, information such as: - the number and date of the contract / acquisition invoked / invoked as similar experience, - the type / categories of services, the value, the beneficiary, the period of supply, - the date and the number of the receipt document. The following supporting documents proving that the requirement is met shall be submitted, upon request, only by tenderers ranked first 3 in the intermediate ranking drawn up on completion of the evaluation of tenders: - certificates or documents issued by the beneficiary / acceptance minutes / relevant parts of the contract / acquisition, showing all the elements necessary to confirm the fulfilment of the requirement for similar experience. If a group of economic operators submits a joint offer, then technical and professional capacity shall be demonstrated by pooling the resources of all members of the group. The technical and / or professional capacity of the tenderer can be supported, for the fulfilment of the Framework Agreement and the Subsequent Contracts, and by another person, regardless of the nature of the legal relations between the tenderer and that person. Where the tenderer demonstrates its technical and / or professional capacity by submitting a firm undertaking to support, confirming that it will make available to the tenderer the technical and professional resources invoked by a / third party / third party, it shall then be required to submit the documents submitted to it by the supporting third party / third party / s, resulting in the actual way in which the supporting third party / third party / s will / will ensure that its own support commitment is fulfilled, which shall be annexed to that undertaking. The supporting documents proving the commitments / agreements will be requested only to the top 3 bidders in the intermediate ranking drawn up on completion of the evaluation of the tenders. For contracts whose value is expressed in foreign currency other than lei, the date on which the equivalent of the leu / other currency will be calculated: - according to the B.N.R. course on the date of publication of the contract notice.

The tenderers shall demonstrate the implementation of the quality management system in the field of the main / main activity / activities covered by the contract, according to SR EN ISO 9001 or equivalent. The DUAE will be completed by the economic operators participating in the award procedure. The following supporting documents proving the fulfilment of the requirement shall be submitted only by tenderers ranked first 3 in the intermediate ranking drawn up on completion of the evaluation of tenders: - certificate valid at the time of presentation issued by an accredited certification body attesting compliance by the economic operator with the standard SR EN ISO 9001 or equivalent or with other evidence or evidence confirming that an appropriate quality level is ensured (for specific cases provided for by law). Applicants shall not be eligible for certification. Providers who provide documentation showing that the certification audit has been completed shall receive their own certification. If the economic operator invokes subcontractors / associates or if a joint offer is submitted, the requirement will be met individually by the subcontractor / each member of the association for the part of the contract they make. The document shall be valid at the date of presentation.
