Economic operators submitting a tender must prove a form of registration in accordance with the law, and foreign economic operators must prove a form of registration in accordance with the law of their country of residence, showing that the economic operator is legally established and is not in any situation of annulment of its establishment. The registration document must show that tenderers hold the CAEN (NACE) code relevant to the award procedure. Method by which fulfillment of the requirement can be demonstrated: the ESPD will be completed by the economic operators participating in the award procedure with the information pertaining to their situation. Supporting documents proving the fulfillment of the commitments made by completing the ESPD, namely the Trade Register certificate issued by the ONRC, or in the case of foreign tenderers, equivalent documents issued in the country of residence, are to be submitted, at the request of the contracting authority, only by the tenderer ranked first. These documents may include: - Trade Register certificate issued by the National Trade Register Office attached to the Territorial Court, showing the main/secondary field of activity and their corresponding CAEN codes. The Trade Register Certificate must contain true/current information as of the date of document submission. In the case of a tender submitted by an association, the CAEN code in the ONRC Trade Register certificate submitted by each member of the association must correspond to the part of the contract that it will perform. The registration document must show that the tenderers hold the CAEN code relevant to the award procedure. The CAEN codes of all association members must cover the entire subject matter of the contract. - In the case of an NGO / Non-profit legal entity, the following documents certifying that the signatory is authorized shall be submitted: Articles of Association with up-to-date amendments (including court session minutes/orders). - Foreign legal/natural persons: To demonstrate their capacity to pursue the professional activity, the economic operator shall submit documents proving the form of registration/certification or professional affiliation, in accordance with the law of the economic operator's country of residence. If the tender is submitted by an association, each partner (including the leader) shall submit these documents for the part of the contract that it will perform.

Tenderers shall declare subcontractors at the time of tender submission and complete a separate ESPD to this effect (a requirement also applicable to the supporting third party, if any). Tenderers shall submit, along with the ESPD, the third-party support undertaking (together with annex documents to the undertaking, provided to them by the supporting third party/parties, demonstrating the actual manner in which their support will materialize), the association agreement, and the subcontracting agreement (where applicable). Supporting documents proving the commitments undertaken in the undertakings/agreements will be requested only from the first-ranked tenderer upon request by the contracting authority.
