Maintenance services for integrated computer system for medical activity management

The finding certificate issued by the ONRC - Economic operators submitting tenders must prove a form of registration under the law of the resident country, showing that the economic operator is legally constituted, that he is not in any of the situations of annulment of the constitution, and that he has the professional ability to perform the activities covered by the public contract.

(Article 172 of Law 98 / 2016) The requirement applies also to subcontractors supplementing information related to their situation at the level of a separate DUAE. All documents must be valid at the time of presentation. Method of implementation: The DUAE will be supplemented by economic operators participating in the procurement procedure with the information requested by the contracting authority - information on the fulfilment of the requirements for the ability to pursue the professional activity.

The supporting document proving the fulfilment of those assumed by the completion of the DUAE, i.e. the finding certificate issued by the ONRC, or in the case of foreign legal / physical bidders, the equivalent documents issued in the country of residence, translated into Romanian, are to be submitted, at the request of the contracting authority, only to the highest bidder in the intermediate ranking, after completion of the evaluation of tenders. (art. 196 para 1 of Law 98 / 2016 and art. 132 of GD 395 / 2016) The document must be valid on the date of presentation.

Where parts of the contract will be executed by subcontractors, proof of registration and correspondence of the main / secondary activities within the contract with the object of the acquisition will also be required by subcontractors for the part of the contract they will perform.

In order to demonstrate the technical and professional capacity, given the specificity of the services to be provided, the contracting authority shall request information and documents, considered relevant for the performance of the contract, as follows: a. List of the main similar services provided during a period covering at most the last 3 years, indicating the values, data and public or private beneficiaries. (art. 179, letter b of Law 98 / 2016) The tenderers will demonstrate the fulfilment of the requirements by completing and submitting the form "list of similar services" with information related to their situation, supporting documents (certification for the most important similar services).

The bidders must provide proof that over the last 3 years (calculated up to the closing date for the submission of tenders) they have provided similar maintenance and repair software services of at least 564,000,00 lei without VAT, at the level of at least 1 or maximum 3 contracts.

Method of delivery: The tenderers will demonstrate the fulfilment of the requirements by completing and presenting the DUAE with the information related to their situation, the supporting documents will be submitted only by the highest bidder in the intermediate ranking after completion of the evaluation phase of the tenders, according to Article 196 para. (2) of Law no. 98 / 2016 on public procurement, at the request of the contracting authority.

Certificates may be: copies of relevant parts of contracts / procedure - verbal / certificate / recommendation / any other documents. - documents / contracts / minutes of partial reception or at the end of the provision of services, etc., issued and signed by the beneficiary, from which the provision of similar services results. When a group of economic operators submits the joint offer, technical and professional capacity is demonstrated by taking into account the resources of all members of the group.

The following documents will be submitted with DUAE: the firm commitment of the supporting third party from which the actual way in which its support, subcontracting agreement and / or association agreement will materialise, as appropriate.

Economic operators submitting tenders shall submit certificates issued by ORDA in accordance with Article 72- 81 of Law no. 8 / 1996 on copyright or authorization / agreement by the manufacturer of the information system, attesting that the provider is authorised to implement and provide maintenance services of the software subject to the procedure. The requirement shall also apply to subcontractors and / or third-party supporters who supplement information related to their situation at the level of a distinct DUAE.

Method of implementation: DUAE will be completed by the economic operators participating in the award procedure with information related to their situation.

The supporting documents proposing the fulfilment of those assumed by the completion of the DUAE, or in the case of foreign bidders, equivalent documents issued in the country of residence, shall be submitted, at the request of the contracting authority, to the tenderer ranked 1st in the intermediate ranking after the completion of the evaluation phase of the tenders, according to Art. 196 paragraph 2 of Law 98 / 2016 with subsequent amendments and additions.
