Application No 1 - Registration in the trade register Economic operators submitting tenders must prove a form of registration under the law of the country of residence, showing that the economic operator is legally constituted, that he is not in any of the situations of annulment of the constitution and that he has the professional ability to perform the activities covered by the contract.

Method of fulfilment and applicability within the procedure: The DUAE shall be completed by each entity that participates with or is included in the tender.

Documentary evidence: At the request of the contracting authority, the tenderer ranked first following the ranking drawn up by the evaluation committee shall be required to submit the following supporting documents proving the fulfilment of those assumed by the completion of the DUAE for each entity participating in the tender or included in the tender: - for the Romanian economic operator, a certificate issued by the Trade Register Office of the competent territorial court. From the certificate / extract from the register, presented, must result:

the main activity object and the secondary activity objects. The subject matter of the contract must have a corresponding in the authorised CAEN code of the economic operator.
the legal situation of the tenderer and his condition;
the legal representatives the information contained in this document must be real / actual at the time of presentation. - for foreign economic operator: the tenderer will present edifying documents, translated into Romanian by an authorized translator, real / actual at the time of presentation, which will prove a form of registration as a physical / legal person or of registration / attestation or membership from a professional point of view and in which to mention persons representing the entity in relations with third parties, in accordance with the legal provisions of the country in which the tenderer resides. The documents submitted must also include information on the tender status.

Requirement No 1 - The turnover The average of the overall turnover of the bidder over the last three years (2023, 2024, 2025) must be equal to or greater than the sum of 2,970,000,00 lei. Documentary evidence: The supporting documents proving the fulfilment of those undertaken by the completion of the DUAE are to be submitted, at the request of the contracting authority, only by the highest bidder following the application of the award criterion.

The supporting documents proving the fulfilment of those undertaken by the completion of the DUAE are the balance sheets for the last 3 years (2023, 2024, 2025), recorded with the competent bodies, according to the legal provisions in force or other relevant documents (financial audit reports prepared by the specialised entities, or verification balances undertaken by the economic operator, if the situations related to the financial year ended have not yet been completed according to the provisions of the relevant relevant legislation). Method of delivery: The DUAE shall be supplemented with information on the levels of turnover recorded in the indicated years.

Requirement No 1 Similar experience Tenders must provide proof of supply at the level of one or more service contracts, amounting to cumulated at least 1,485,000 lei without VAT. Similar services include technical and functional support services for IT systems or IT maintenance services or integrated IT systems development services. Indication of the main services provided in the last 3 years shall be requested, with indication of the values, supply dates, beneficiaries of those services.

In the event of a delay in the time limit for submission of tenders, it will also extend accordingly (with days of delay) and the period of similar experience.

Documentary evidence: Evidence of fulfilment of the qualification criteria will be required, namely the presentation of certificates / documents / recommendations / minutes of receipt (dated and signed by the beneficiary) confirming the similar experience requested, respectriv declared, during the period indicated, as well as any other documents deemed relevant in proving that the requirement was met by the economic operator ranked first.

Method of fulfilment and applicability of the procedure: The DUAE shall be supplemented with information on contracts or parts of contracts (or other legal commitments) performed during that period, indicating their products / services / works, value and beneficiaries. The information will be detailed in the DUAE so that it can be verified that the requirement in terms of period, similarity of products / services / works, values or quantities indicated at the level of the requirement can be verified.

Requirement 2 - The proportion of subcontracting the tenderer shall specify the part (s) of the contract it intends to subcontract, the percentage of the contract corresponding to the activities to be carried out by the subcontractor for each subcontractor as well as the identification data of subcontractors (at least, legal form - SRL, SA, etc.).

If the tenderer subcontracts parts of the contract, the tenderers will submit with the DUAE the subcontracting agreement resulting at least from the information on the subcontractor and the identification data, the part / parts of the contract to be performed by the subcontractor and the actual way in which the subcontractor ensures that the obligations assumed are met.

Method of implementation: The DUAE Form will be completed (Part II - Part IV - Selection criteria, C - Technical and professional capacity) with reference data / information in relation to Article 179 letter k) of Law no. 98 / 2016.
