FRAMEWORK AGREEMENT FOR WARRANTY AND TECHNICAL SUPPORT SERVICES FOR CISCO ASR 9010, CISCO ASR 9904 AND CISCO ASR 9901 EQUIPMENT

In Stage I, the following supporting documents will be presented showing the capacity of each economic operator participating in the procedure to provide the services that fall under its responsibility during the implementation of the framework agreement:

1. For Romanian legal entities: the certificate issued by the Ministry of Justice - the National Office of the Trade Register, from which the full name, registered office and working point (s), authorized persons (administrators / authorized persons), main activity area / secondary activity areas and related CAEN codes will be presented.
2. For foreign legal entities: edifying documents proving a form of registration / attestation or professional membership shall be required in accordance with the legislation of the country of residence of the economic operator.
3. For Romanian / foreign individuals: edifying documents will be required to prove a form of registration as an authorized natural person, in accordance with the legislation of the country of residence of the economic operator.The submission / submission of documents required under this section shall be permitted in any of the original forms / certified copies / legible copies with the words "in accordance with the original." In stage I, a certificate / authorization will be presented by CISCO Systems, the manufacturer of equipment and software regarding the operation, support and maintenance of hardware products for which the technical support service is purchased.

Minimum qualification requirement: The average global turnover of the candidate over the last 3 years (2023, 2024 and 2025) must be at least USD 400,000,00 without VAT.

In the first stage, Form No 4 - Statement on global turnover for the last 3 years, in original, with mandatory supporting documents showing the average annual turnover for the last three financial years (2023, 2024, 2025), i.e. balance sheets or balance sheets for the financial years 2023, 2024, 2025 validated by the competent bodies, or any other edifying documents that support unequivocally the information in the Form.

Where the publication of the balance sheets is not provided for by the legislation of the country in which the economic operator or balance sheet for 2025 is established has not been drawn up, approved and registered with the competent bodies, any other equivalent documents may be submitted, considered edifying in the country of residence of the economic operator by which the information given in Form 4 can be supported (e.g. annual report of auditors, financial and accounting audit report, balance of verification on 31.12.2025, etc.).

The USD equivalent of the annual turnover in lei will be determined on the basis of the following annual average courses communicated by the National Bank of Romania (NBR) for the years 2023, 2024 and 2025: 4,5743 lei / USD for the year 2023, 4,5984 lei / USD for the year 2024 and 4,4705 lei / USD for the year 2025.

For the conversion of other national currencies into USD, the annual average exchange rates established by the NRB for the respective national currency / USD shall be used for reference years 2023, 2024 and 2025 (see website www.bnr.ro). All such supporting documents may be presented in any of the original forms / certified copies / certified copies of the original.

The certification for conformity shall be made by the legal / empowered representative of the economic operator concerned by the entry "in accordance with the original" on each page, together with the signature of the person concerned. Documents issued in another language shall be presented together with the authorised translations in Romanian.

Where the candidate demonstrates the fulfilment of the minimum requirement for economic and financial situation by invoking the support granted by another person, in accordance with Article 161 of the O.U.G. No 114 / 2011, as amended and supplemented thereafter, he shall be deemed to be qualified if the supporting third party demonstrates the fulfilment of the minimum requirement required by the submission of the abovementioned relevant documents.

At the same time, in this case, it is mandatory to present the firm commitment of the respective supporter, concluded in accordance with the provisions of Article 161 of the O.U.G. No 114 / 2011, with subsequent amendments and additions, which become an integral part of the framework agreement.

With the support commitment, the candidate is required to submit documents submitted to him by the supporting third party (s), resulting in the actual way in which the supporting third party (s) will / will ensure that his / her own support commitment is fulfilled, which will be attached to that commitment, becoming an integral part of the framework agreement.

The person providing support for economic and financial capacity must not be in any of the situations leading to exclusion from the award procedure as provided for in Articles 155 and 156 of the O.U.G. No 114 / 2011, with subsequent amendments and additions. Where the candidate is a group of economic operators, the minimum requirement for the economic and financial situation may be met by cumulation.

The candidate must be able to ensure the protection of classified information "secret service" level, which will be accessed at the premises of the contracting authority, proven by obtaining the security notice issued by the specialised unit within the Special Telecommunications Service. In Phase I, the Form no. 11 - Self-declaration on the protection of classified information shall be presented, in original, accompanied by the following documents:

1. the document of establishment;
2. the certificate of establishment issued by the Ministry of Justice - the Office of the Trade Registry;
3. the tax record and the criminal record of the company;
4. Industrial security questionnaire for access to classified information (Form no. 12) in original, signed and stamped.The required documents shall be made available to the specialised unit within the Special Telecommunication Service by the contracting authority with a view to carrying out the security checks necessary for issuing the security notice, in accordance with the provisions of the legislation in force concerning the protection of classified information.The security notice shall be the document issued by the specialised unit of the Special Telecommunications Service, attesting that the industrial objective (economic operator) has implemented all the security measures necessary to protect the classified information carried out during the framework agreement and accessed at the premises of the contracting authority.With a view to issuing the security notice, the specialised unit within the Special Telecommunications Service will proceed to carry out the security visit to the premises of each candidate.In the event of an application submitted in association or in which one or more third parties supporting / aubcontractors have been nominated, it is mandatory to submit Form 11 under the signature of the legal / empowered representative of each of the economic operators participating in the procedure as candidate / associate / third-party supporter / subcontractor, accompanied by all other documents required under this point.In order for the application to be declared admissible in terms of capacity to ensure the protection of classified information "secret service" level, it is mandatory that each of these economic operators participating in the procedure as candidate / associate / third-party supporter / subcontractor obtain the security notice.In other words, failure by one of the economic operators nominated at the level of an application, irrespective of its quality (candidate / associate / third-party supporter / subcontractor) will automatically lead to the rejection of that application as unacceptable. The documents submitted will contain current / real information at the deadline for submitting applications.With the exception of the industrial security questionnaire to be presented in the original, all other documents accompanying Form 11 may be presented in any of the original forms / certified copies / legible copies with the words "in accordance with the original." Certification for compliance with the original shall be made by the legal / empowered representative of the economic operator concerned by the entry on each certified page of the entry "according to the original," accompanied by the signature of the person concerned, the contracting authority reserved- and the right to require the presentation of the original documents / certified copies in order to verify compliance with the original of the copies submitted. The candidate must have provided in the last five years, calculated by the deadline for submitting applications, services similar to those covered by the procurement procedure. The term "Similar services" means technical support services for the diagnosis and repair of hardware and software defects for CISCO-type equipment ASR 9000 series.

In Stage I, Form No 5 - Declaration on the main similar services provided in the last five years, initially, with mandatory supporting documents / documents relevant for each of the contracts nominated for this form, whereby the candidate proves similar experience: certificates / documents issued or countersigned by contracting authorities or private customers, beneficiaries of services, such as: quantitative and qualitative reception minutes, recommendations, certificates or any other equivalent edifying documents attesting to the actual provision of services.

In order to demonstrate its capacity to provide services representing similar experience, the candidate must demonstrate that these services have been received.

The same experience required is not similar to what is to be acquired but relates to categories / types of services of complexity comparable to those covered by the framework agreement to be awarded, with a general description being used in relation to the area in which it falls, ensuring that the candidate is able to understand the requirements of the contracting authority. All such supporting documents may be presented in any of the original forms / certified copies / certified copies of the original.

If the candidate demonstrates the fulfilment of the minimum technical and / or professional capacity requirement by invoking the support granted by another person pursuant to Article 165 of the O.U.G. No 114 / 2011, as amended and completed, he shall be deemed to be qualified if the supporting third party demonstrates the fulfilment of the required minimum requirement by submitting the relevant documents referred to above.

At the same time, in this case, it is mandatory to present the firm commitment of the respective supporter, concluded in accordance with the provisions of Article 165 of the O.U.G. No 114 / 2011, with subsequent amendments and additions, which become an integral part of the framework agreement.
