The economic operator must have a form of registration under the law of the country of residence, thus proving that it is legally constituted, that it is not in any of the situations of annulment of the constitution, and that it has the professional capacity to perform the activities covered by the contract. The requirement shall also apply to subcontractors who supplement information related to their situation at the level of a distinct DUAE. In the case of an association, each associate shall be obliged to prove that the requirement is met. The economic operators participating in the procedure (individual tenderers, associated bidders, subcontractors) will complete the DUAE with YES or NO the information related to their situation in accordance with Article 193 (1) of Law No 98 / 2016. The contracting authority will accept, at the time of submission of the DUAE form, preliminary evidence confirming that the economic operator concerned meets the required requirements, and before determining the successful tender, the highest bidder in the ranking drawn up on completion of the evaluation of tenders after the application of the award criterion, may submit updated and valid supporting documents at the time of submission demonstrating that all criteria for qualification and selection are met, in accordance with the information declared in the DUEA. At the same time, in accordance with the provisions of Article 196 (1) of Law 98 / 2016, the contracting authority may require tenderers to submit all or part of the supporting documents as proof of the information declared in the D.U.A.E. at any time during the award procedure, if this is necessary for the proper conduct. The supporting documents to be requested by the contracting authority in accordance with the provisions of Article 132 (2) of HG no. 395 / 2016 and which prove that those assumed by completion of the DUAE are: - The finding certificate issued by the National Trade Register Office, resulting in the identification data of the economic operator, shareholders / associations, management bodies, administrators, members of the Management Board, members of the Supervisory Board, participation quotas, main / secondary activity area, the CAEN codes related thereto. The CAEN code of the activity of the tenderer must be appropriate to the subject matter of the contract. The finding certificate will have to be submitted by each economic operator participating in the award procedure (individual or associate tenderer, third party (s) supporter (s), subcontractor / subcontractors). In the case of an association, documents attesting the form of registration shall be submitted for each of the members of the association. In order to fulfil the requirement, it is sufficient that each member's activity is consistent with the part of the contract it will perform. For the above-mentioned document, foreign bidders may submit equivalent documents in copy in accordance with the original, issued in the country of residence, translated into Romanian signed and initialled by an authorised translator, proving a form of registration / attestation or professional affiliation, in accordance with the laws of the country of residence of tenderers, attestation documents that will show elements such as full name, duration of service, registered office, associates / shareholders, authorized persons / administrators, authorised areas of activity

Tenderers are required to present the minimum annual turnover for the last three available financial years, respectively for the years 2025, 2024, 2023. The minimum level of the tenderer's annual turnover for the last three available financial years, respectively the years 2025, 2024, 2023, must be at least equal to RON 196,100.00. Tenderers and third-party supporters shall complete the ESPD with the information requested by the contracting authority, information necessary to demonstrate economic and financial standing. Economic operators participating on their own behalf shall submit a single ESPD. Economic operators relying on the capacities of other entities (third-party supporters / subcontractors) shall submit their own ESPD and a separate ESPD for each of the entities they rely on. Economic operators submitting a tender in an association / group shall submit an ESPD for each member of the association / group. The contracting authority will accept, at the time of submission of the ESPD form, as preliminary evidence confirming that the economic operator in question meets the requirements requested to demonstrate economic and financial standing, with the proviso that prior to determining the winning tenders, the tenderer ranked first following the application of the award criterion must present supporting documents demonstrating compliance with these requirements, in accordance with the information contained in the ESPD. The supporting documents through which the tenderer ranked first can demonstrate fulfillment of the requirement are, the list not being cumulative: balance sheets for the last three available financial years (2025, 2024, 2023), endorsed and registered by the competent authorities, showing the minimum turnover value for each financial year; financial audit reports drawn up by specialized entities; appropriate bank statements or declarations; financial statements or extracts from financial statements, where publication of financial statements is required by the legislation of the country where the economic operator is established. Documents issued in another language shall be submitted accompanied by certified translations into Romanian. If the Tenderer demonstrates fulfillment of the minimum requirement regarding economic and financial standing by invoking the support provided by another person, in accordance with the provisions of Art. 182 of Law no. 98/2016, as amended and supplemented, it shall be deemed qualified if the third-party supporter demonstrates fulfillment of the requested minimum requirement by submitting the relevant documents. At the same time, in this case, it is mandatory to submit the firm commitment of the supporting person, as well as the documents transmitted to the tenderer by the third-party supporter, showing the actual manner in which it will ensure the fulfillment of the commitment, documents that will constitute annexes to the respective commitment. In case third-party support is invoked, failure to submit along with the tender the ESPD completed by the respective third-party supporter, its firm commitment, and the attached documents showing the actual manner in which the support provided will materialize, will result in the rejection of the tender in question as unacceptable. If the tenderer is a group of economic operators (associated tenderers), the minimum requirement regarding economic and financial standing may be met cumulatively. If the group of economic operators demonstrates fulfillment of the minimum requirement regarding economic and financial standing by invoking the support provided by a third party, the method of fulfilling the requirement is similar to that for the individual tender mentioned above, with the specification that the support will be granted to the association and not to one of the associates. Tenderers (individual tenderer, associates in the case of joint tenders and, if applicable, the supporting third party in the case of third-party support) must provide proof that they have performed and successfully completed in the last 3 years services similar to those subject to the future contract to be awarded, with a cumulative minimum value of RON 196,100.00 excluding VAT, across a maximum of 3 contracts. By “services similar to those subject to the future contract to be awarded” is meant: - Maintenance and support services for storage systems, which have been successfully completed. By “successfully completed services” is meant: a) partially accepted services, provided that the specifics of the contract / activities representing similar experience allow for the preparation of a deliverable that can be used by the beneficiary as an independent result; b) services accepted at the end of the service provision. Means of fulfillment: In the ESPD, the economic operators participating in the award procedure (individual tenderer / associated tenderer / supporting third party) will complete a list of relevant information describing their level of similar experience, across a maximum of 3 service provision contracts and demonstrating the achievement of the required value thresholds, information such as: - the number and date of the contract invoked as similar experience; - the type, subject matter, and value of the contract; - the contract beneficiary and their contThe nominated associate(s) will submit a separate ESPD containing the requested information describing their level of similar experience. In the event that the economic operator demonstrates its technical and professional capacity by also invoking support granted by a third party / third parties (pursuant to Articles 182-184 of Law no. 98/2016, as subsequently amended and supplemented), it is obliged to prove the support it benefits from by submitting a firm commitment from that person. The person providing support for similar experience as part of the technical and professional capacity must not be in a situation that leads to exclusion from the award procedure according to the provisions of Articles 164, 165, and 167 of Law no. 98/2016, as subsequently amended and supplemented. In the case of a consortium of economic operators for the purpose of submitting a joint tender, the technical and/or professional capacity requirements may be fulfilled by taking into account the resources of all group members. In the case of a consortium, each associate will submit the documents requested for the leader, given that the requirements regarding the personal situation of the tenderer will be fulfilled by each associate individually, and those regarding the Capacity to pursue the professional activity will be fulfilled by each associate individually, in accordance with the part/parts of the contract that theyact details; - the date and number of the acceptance document, as well as the share and/or activities for which they were responsible, together with their value, excluding VAT.they will execute according to the submitted association agreement. Economic operators will indicate in the DUAE information on the part (s) of the contract they intend to subcontract. It shall be completed and transmitted by the economic operators participating in the award procedure with information related to their situation, including subcontractors nominated in the tender. By the deadline set for the submission of tenders, the participating economic operators will submit the DUAE duly completed by each participating entity (where applicable, tenderer, declared subcontractor) together with the Subcontracting Agreement / Agreements in order to provide preliminary proof of the fulfilment of the above requirements. The subcontracting agreement / firm support commitment will be submitted with the DUAE. If a qualification requirement is not met by the subcontractor, it will only submit the DUAE for demonstration of non-compliance with the exclusion grounds. The contracting authority shall require, upon conclusion of the public procurement contract, the submission of subcontracting contracts concluded between the future contractor and subcontractors nominated in the tender.
