Market access software license procurement

1. The presentation of the applicant company or of the member of the applicant community must contain information about its locations, service portfolios, as well as the size and – if applicable – information about the group structure must be submitted. The company statement shall be attached to Form 2.
2. Professional and Commercial Registration Statement, Declarations and Certificates (Form 5) The applicant must submit proof of registration in the commercial register and/or professional register of the country in which the applicant is established. An extract from the register must be up-to-date in content at the time of the deadline for participation and must not be older than six months.The relevant registers for Germany are: the ‘Handelsregister’, the ‘Handwerksrolle’ and, in the case of service contracts, the ‘Vereinsregister’, the ‘Partnership Register’ and the ‘Registers of Members of the Professional Chambers of the Länder’; for the other Member States of the European Union, the requirements set out in Annex XI to Directive 2014/24/EU of the European Parliament and of the Council of 26 May 2014 may apply.February 2014 on public procurement and repealing Directive 2014/18/EC, OJ L 94, 28. As evidence, the documents listed in the respective host state can be submitted accordingly. If the applicant is unable to provide a copy of the register, the alternative declaration required in Form 5 shall be provided.

The proof of liability insurance for the liability risks for property, personal and financial damage resulting from the applicant's commercial activity shall be provided by a valid insurance confirmation. The insurance must cover the aforementioned risks at an appropriate level.

Financial statements/annual reports/economic indicators Financial statements, including annexes, auditor releases, management reports and comments, if their publication is required by law in the country in which the applicant is admitted, shall be submitted for the financial years 2023, 2024, 2025 or, if not yet available for the last required financial year, the last three financial statements available. In any case, applicants must provide information on turnover, specific turnover in the field of activity of the contract to be awarded here, net profit for the three financial years 2023, 2024 and 2025.

The turnover in the field of activity of the contract to be awarded here must be at least 6 million in the last completed financial year. EUR. The specific turnovers for the years 2023 and 2024 are to be given informatively.

Company references The proof of experience in the area of the services to be awarded here is required by specifying references comparable with the subject-matter of the contract in accordance with the following provisions: (i) Subject-matter Only references which correspond to the subject-matter of the service and thus meet the requirements for the comparability of the reference are taken into account (see (v) below). (ii) Reference period Only references whose services have been provided in the past 5 years (deadline date is the date of the contract notice) will be considered. (iii) Minimum number of references The applicant shall provide at least 3 references. (iv) Maximum number of references The applicant may submit a maximum of 5 references. (v) Comparability of reference A contract shall be taken into account as a reference if it is comparable in nature, scale and difficulty with the activity to be awarded.

Comparability shall be ageed when the information required by the table in the section ‘Comparability of reference performances’ in Form 7.1 is complete and the minimum conditions are met. All information provided by the applicant shall be verifiable. The client reserves the right to a review.

The contracting entity sets the following minimum reference requirements: (vi) Number of references in the energy sector At least 1 (one) of the submitted references must come from the energy sector (electricity, gas or heat). (vii) Duration of reference Each reference must have a minimum duration of 24 months. (viii) Different licensors Applicants shall specify the number of licensors per reference. Only references that include at least 40 different licensors are considered.

Relevant is the maximum value achieved by the licensors under the named reference. (ix) Employees of the reference company Applicants shall indicate the number of employees of the reference company.

Only references provided by a company that has at least 800 employees are considered. (x) Additional information The applicant is entitled to provide additional information about the reference in an attachment to the respective Form 7.1 if one or more required information cannot be provided or cannot be completed and this is necessary to understand the reference from the perspective of the applicant.

The additional information must not exceed one DIN A4 page per reference. (xi) Proof For proof, the applicant shall complete Form 7.1 for each reference. The form shall be used several times. By specifying the reference, the candidate confirms that he has obtained the consent of the reference contractor to indicate the contract as a reference in this procurement procedure with the information requested by the contracting entity.

By specifying a contact person and his contact details of the reference contractor, the applicant confirms that the contact person of the reference contractor has agreed to be contacted by the customer by means of the specified contact possibilities.

If the contact details cannot/cannot be provided in full (e.g. for data protection reasons), the applicant must ensure in another way that contact with the reference client, including a corresponding check, is possible without the presence/presence of the applicant/tenderer. All information provided by the applicant shall be verifiable. The client reserves the right to a review.

Only applicants who can demonstrate that they have implemented an ISO 27001 compliant information security management system (ISMS) and that the subject-matter of the award is fully covered by the ISMS scope are admitted. This information shall be provided in Form 7.2. Applicants may attach their own attachments for demonstration.
