Procurement of a software application for school child care and school catering

The public call for competition serves to select interested and suitable candidates. Candidates are selected in accordance with the suitability and selection criteria specified in the procurement documents. Proof of the suitability of the company or bidding consortium is verified on the basis of the explanations and evidence required below (see application form). In the case of a bidding consortium, these declarations apply accordingly to each member.

1. Company details (name and legal form, representation, contact details).
2. Declaration on the composition of a bidding consortium (Section 43 VgV). This declaration cannot be submitted retroactively.
3. Declaration regarding planned subcontracting, provided that parts of the contract are to be subcontracted to third parties in the event of an award (Section 36 VgV).
4. Self-declaration on an intended reliance on the capacities of other entities, provided that the capacity of another company is utilized to prove suitability (Section 47 VgV). This declaration cannot be submitted retroactively.
5. Self-declaration that the performance of the service is carried out independently of execution and delivery interests, in particular through economic links with other companies, and that no interests exist that conflict with or could adversely affect the execution of the contract (Section 46 (2) VgV).
6. Self-declaration on the absence of grounds for exclusion (Sections 123 and 124 GWB).
7. Self-declaration that the obligations regarding compliance with collective agreements and minimum pay under the State Act on Collective Agreement Compliance and Minimum Wage for Public Procurement in Baden-Württemberg (LTMG) are met.
8. Self-declaration that only products manufactured and/or processed in compliance with the minimum standards established in the core labor standards of the United Nations International Labour Organization (ILO) will be used in the performance of the contract.
9. Self-declaration on compliance with EU sanctions against Russian companies / individuals / suppliers (ban on awarding contracts).
10. Proof that the company holds professional or commercial third-party liability insurance throughout the entire performance period with a coverage amount of at least EUR 1 million for personal injury and property damage per claim. The compensation payment must amount to at least twice the insured sum per year (Section 45 (1) No. 3 and (4) No. 2 VgV).Evidence from the insurance company confirming that the coverage amount will be adjusted in accordance with the requirements in the event of an award may also be submitted. For bidding consortia, this applies accordingly to each member. A self-declaration is not sufficient; an up-to-date certificate or confirmation from the insurance company (maximum 12 months old at the time of publication) must be submitted.
11. Self-declaration that the average annual turnover in the last three financial years 2023, 2024, and 2025 was at least EUR 1 million (figures are added and averaged), insofar as it relates to services comparable to the service to be awarded, including the share of services performed jointly with other enterprises (Section 45 (1) No. 1 VgV).
12. Proof of certification according to ISO/IEC 27018:2019 (Code of practice for protection of personally identifiable information (PII) in public clouds acting as PII processors) or equivalent certification.In the case of requests to participate submitted by bidding consortia or the involvement of subcontractors, all members of the bidding consortium or the subcontractors engaged must be incorporated into the certified quality management system.In such cases, in addition to the certification, a demonstration must be submitted showing that all members of the bidding consortium or the subcontractors engaged are included in the quality management system certified according to ISO/IEC 27018:2019.
