Providing a framework for maintenance and technical support services for OnBase platform and SPID computer system

Economic operators submitting tenders must prove a form of registration under the law of the country of residence, showing that they are legally constituted, that they are not in any of the situations of annulment of the constitution and that they have the professional capacity to carry out the activities covered by the framework agreement. Method of fulfilment: the DUAE will be completed by the economic operators participating in the award procedure with information related to their situation. The supporting documents proving the fulfilment of those declared, i.e. the finding certificate issued by the ONRC or, in the case of foreign bidders, equivalent documents issued in the country of residence, are to be submitted, at the request of the contracting authority, only by tenderers ranked in the first two places in the intermediate ranking drawn up on completion of the evaluation of tenders. The main and secondary activity (if any) and the relevant CAEN codes must be derived from the certificate. The information in the finding certificate shall be real / valid at the date of its submission. The subject matter of the contract must be corresponding in the CAEN codes (main and / or secondary activities) entered in the certificate and must be authorised in accordance with the provisions of Article 122 (7) and (9) of Law No 265 / 2022 on the register of trade and for amending and supplementing other normative acts affecting the registration in the register of trade. Foreign legal entities will present documents in translation authorized in Romanian. The document will have to be presented by both the tenderer and the associate tenderer, if any.

Economic operators must provide information regarding similar experience. Similar services will be considered those intended for identical or similar uses and that are part of the normal range of services provided by economic operators with regular activity in the respective sector. For the purpose of this requirement, similar services are considered to include, but are not limited to, maintenance and/or technical support services related to IT systems, applications, or platforms, including update, upgrade, patch installation services, and other related activities intended to maintain their functionality, availability, and operational continuity. Economic operators shall demonstrate that they have provided services intended for identical or similar uses, with a cumulative value of at least RON 1,000,000.00 excluding VAT, across a minimum of 1 (one) and a maximum of 3 (three) similar service contracts, by reference to contracts executed in the past, corresponding to the contracting authority's requirements, during a period covering at most the last 3 years, calculated up to the deadline for tender submission set out in the contract notice. Method of fulfillment: the ESPD shall be completed by the economic operators participating in the award procedure with information describing their level of similar experience, by reference to contracts executed in the past, corresponding to the contracting authority's requirements, during a period covering at most the last 3 years, calculated up to the deadline for tender submission set out in the contract notice. Tenderers ranked in the first two places in the intermediate ranking shall submit conclusive documents/certificates relating to each contract invoked as similar experience (recommendations, acceptance certificates/minutes, performance certificates, or other equivalent documents), issued or countersigned by an authority or by the private beneficiary client, proving the provision, within the last 36 months, under a minimum of 1 and a maximum of 3 similar service contracts with a cumulative value of at least RON 1,000,000.00 excluding VAT. The similar experience must have been acquired within a period covering at most the last 3 years calculated up to the deadline for tender submission set out in the contract notice. If the contracting authority is forced, regardless of the reasons, to postpone the deadline established for the submission of tenders, the lower limit of the 3-year period shall be extended by the time period corresponding to the postponement, and the requirement will be considered fulfilled for all operators who provided proof of completion of the contract for similar experience within the newly resulting time interval. Supporting documents shall be submitted in correlation with the contracts mentioned in the list of main service deliveries. Foreign legal entities shall submit the documents in the form of a certified translation, presented in a copy signed as a true copy of the original. In the case of contracts concluded in another currency, the average annual exchange rate of RON / "currency X" published by the National Bank of Romania for the respective year shall be taken into account for conversion into Lei. If a contract was signed and/or started before the 36-month period and/or is ongoing, similar services provided and accepted within the 36-month interval will be taken into account. The following documents shall be submitted along with the ESPD: - the firm commitment of the supporting third party showing the actual way in which their support will materialize (if applicable), accompanied by the documents showing the actual way in which the supporting third party/parties will ensure the fulfillment of their own support commitment, documents which will constitute annexes to the respective commitment pursuant to Art. 182 para.
