What the buyer wants
- The subject of the contract is to provide a licence for laboratory station software with licenses for measurements of 4G radio communication systems as part of the project entitled ‘Public Safety Technology Centre’ No. FEDS.01.01-IZ.00-0003/24.
- A detailed description of the subject matter of the order is given in Annex 3 to the EGM, respectively.
- The detailed scope of the performance of the subject-matter of the contract, which is the proposed provisions of the public contract, is set out in the model contract, which is annexed No 2 to the SWI. 3. Export restrictions The Contractor is obliged to ensure that the subject of the contract offered can be exported, re-exported, transferred and delivered to the Wrocław University of Technology in accordance with applicable regulations.For products, their components, software or technology subject to export control rules, in particular dual-use items originating in the People's Republic of China, The Contractor shall, before submitting an offer, verify the possibility of their legal delivery to the Contracting Authority.Where delivery requires authorisation, licence or other agreement from the competent authority, the Contractor shall be required to obtain it at his own expense and risk. The contractor cannot offer a product which is legally unacceptable to the Wrocław University of Technology.At the request of the Contracting Contractor, the Contractor will be obliged to provide documents issued by the Chinese Ministry of Commerce (MOFCOM) or competent authorities confirming the possibility of legally delivering the goods offered to the Wrocław University of Technology.The Contractor shall be responsible for the consequences of failure to perform the contract or of improper performance resulting from export restrictions existing and acceptable at the date of submission of tenders.

O udzielenie zamówienia mogą ubiegać się Wykonawcy, którzy spełniają warunki dotyczące: 2.1. zdolności do występowania w obrocie gospodarczym Zamawiający nie stawia warunku w powyższym zakresie. 2.2. uprawnień do prowadzenia określonej działalności gospodarczej lub zawodowej, o ile wynika to z odrębnych przepisów Zamawiający nie stawia warunku w powyższym zakresie. 2.3. sytuacji ekonomicznej lub finansowej Zamawiający nie stawia warunku w powyższym zakresie. 2.4. zdolności technicznej lub zawodowej Wykonawca spełni warunek, jeżeli: 2.4.1 Zamawiający uzna warunek za spełniony, jeśli Wykonawca wykaże, że zrealizował należycie w okresie ostatnich trzech lat przed upływem terminu składania ofert, a jeżeli okres prowadzenia działalności jest krótszy – w tym okresie, co najmniej jedną subskrypcję licencji oprogramowania pomiarowego lub laboratoryjnego na minimalną kwotę brutto 100 000 zł (sto tysięcy złotych).
Dla ww. wartości wykazanych przez Wykonawcę w walucie innej niż PLN, Zamawiający przyjmie przelicznik według średniego kursu Narodowego Banku Polskiego dla danej waluty z dnia wysłania ogłoszenia o zamówieniu do BZP).
Stosownie do art. 112 ust. 3 uPzp Zamawiający wskazuje, że określając warunek udziału w postępowaniu, o którym mowa powyżej, w zakresie zdolności technicznej lub zawodowej, nie zastosował poziomów zdolności określonych w przepisach wydanych na podstawie art. 5 ust. 4 lub 5 ustawy z dnia 5 sierpnia 2025r. o certyfikacji wykonawców zamówień publicznych, ponieważ dla przedmiotu niniejszego zamówienia poziomy zdolności nie zostały określone w obowiązujących przepisach wykonawczych.

VIII pkt 3 SWZ (jeżeli dotyczy) 22.4. wykazania zastrzeżenia informacji stanowiących tajemnicę przedsiębiorstwa zgodnie rozdz.
XI pkt 6 (jeżeli dotyczy); 22.5. dokumentu/-ów, z których wynika prawo do podpisania Oferty; odpowiednie pełnomocnictwa zgodnie z rozdz. XI pkt 15 SWZ (jeżeli dotyczy); 22.6. (jeżeli dotyczy) przedmiotowe środki dowodowe zgodnie z pkt 9 rozdz. II SWZ w zakresie oferty równoważnej; Wymóg wskazania: „Nazwa, wersja, producent, typ” wraz z ceną nie stanowi przedmiotowego środka dowodowego.
Przedmiotowym środkiem dowodowym są równoważne normy, oceny techniczne, specyfikacje techniczne i systemy referencji technicznych oraz inne przedmiotowe środki dowodowe, o których mowa w art. 104-107 uPzp, udowadniające, że proponowane rozwiązania w równoważnym stopniu spełniają wymagania określone w opisie przedmiotu zamówienia.
Zgodnie z art. 107 uPzp, w przypadku, gdy Wykonawca nie złożył przedmiotowych środków dowodowych lub złożone przedmiotowe środki dowodowe są niekompletne, Zamawiający wezwie do ich złożenia lub uzupełnienia w wyznaczonym terminie (aktualnych na dzień ich złożenia). Zasady tej nie stosuje się, jeżeli pomimo złożenia przedmiotowego środka dowodowego, oferta podlega odrzuceniu albo zachodzą przesłanki unieważnienia postępowania. 22.7.
Oferta szczegółowa oferowanego przedmiotu zamówienia (podanie danych oferowanego przedmiotu zamówienia: m.in. nazwa, wersja, producent, typ) wraz z kalkulacją ceny – odpowiednio wypełniony i podpisany Załącznik nr 3 do SWZ. Wymóg wskazania: „Nazwa, wersja, producent, typ” wraz z ceną nie stanowi przedmiotowego środka dowodowego.
