The subject of the separate position includes providing a solution for the protection and inspection of DNS traffic for the needs of the Geodesy, Cartography and Cadastre Agency (AGK), including maintenance by the manufacturer for a period of 36 months. If not a manufacturer, the participant should be duly authorised by the manufacturer or his official representative for the right of distribution/delivery of the products offered in the territory of the Republic of Bulgaria; *** The requirement for authorisation at the stage of submission of tenders shall be justified by the subject-matter of the contract and shall constitute a guarantee of its timely and qualitative implementation. In the event that a contractor who is refused authorisation by the manufacturer is selected, this may result in a delay in the performance of the contract and its termination. According to the conclusions of the Supreme Administrative Court, the authorisation requirement is in itself not restrictive insofar as it is a guarantee of quality and reliability of the activity carried out. In normal commercial practice, authorisation shall be based on a contract which may be directly with the manufacturer or with another economic entity authorised to authorise on behalf of the manufacturer. (Decision No 10859 of 27.10.2021 of the SAC under Admiral No 6546/2021). In the documentation, the authorisation condition is extended, i.e. not limited to the manufacturer but also to any official representative of the manufacturer. A general authorisation is required, not for a specific procedure and an opportunity is provided for each interested participant - a partner, whether Bulgarian or foreign, to submit a tender, and an opportunity to prove the above fact is provided, both with a letter of approval and with any other equivalent document certifying compliance with the requirement. *** The requirements for implementation are detailed in the Technical specification of THE ADVANTAGE under the position assigned to the Annex No 1.1.

В предмета на обособената позиция се включва осигуряване на решение за защита и инспекция на DNS трафика за нуждите на Агенция по вписванията (АВ), включително поддръжка от производителя за срок от 36 месеца. В случай че не е производител, участникът следва да е надлежно оторизиран от производителя или негов официален представител за правото на разпространение/доставка на предлаганите продукти на територията на Република България; *** Поставеното изискване за оторизация на етап подаване на оферти, се обосновава от предмета на поръчката и представлява гаранция за нейното своевременно и качествено изпълнение. В случай, че бъде избран изпълнител, на когото му бъде отказана оторизация от производителя, това може да доведе до забавяне на изпълнението на обществената поръчка, както и до нейното прекратяване. Според заключенията на Върховния административен съд, изискването за оторизация само по себе си не е ограничително, доколкото е гаранция за качество и надеждност на извършваната дейност. В обичайната търговска практика оторизацията става въз основа на договор, който може да бъде директно с производителя или с друг икономически субект, упълномощен да оторизира от името на производителя‘‘. (Решение № 10859 от27.10.2021 г. на ВАС по адм. д. № 6546/2021 г. VIIо.). В документацията условието за оторизация е поставено разширително, т. е. не е ограничено единствено до производителя, но и всеки негов официален представител. Изисква се обща оторизация, а не за конкретна процедура и е предоставена възможност за всеки заинтересован участник – партньор, независимо дали е българско или чуждестранно лице, да подаде оферта, като е предоставена възможност за доказване на горепосоченото обстоятелство, както с оторизационно писмо, така и с всеки друг еквивалентен документ, който удостоверява съответствието с поставеното изискване. *** Изискванията към изпълнението са подробно описани в Техническата спецификация на ВЪЗЛОЖИТЕЛЯ по обособената позиция – Приложение № 1.2.
