What the buyer wants
The subject matter of the contract shall be the provision of support services carried out in the technical environment of the Ordering Party described in Annex No 1, to the extent specified in Annex No 2, i.e. maintenance services and programming services. The basic contract shall cover the provision of support services for a period of 24 months, including maintenance and programming services with a maximum of 1500 man-hours. Right of option: The Ordering Party provides for the option to be exercised.
Under the option law, the contract will include the provision of support services for a further 12 months, including the provision of maintenance services during that period and programming services within the remaining, inexhaustible part of the envelope of programming services provided for under the basic contract. The provision of support services will start on the first calendar day following the completion of the support service under the basic contract.
The Contracting Authority shall inform the Contractor of the exercise of the right of option within 1 month at the latest before the expiry of the time limit for the provision of services under the basic contract. A detailed description of the subject-matter of the contract is contained in the draft provisions of the Agreement, which constitute Annex 4 to the EGM.

- The Economic Operator is required to demonstrate that within the last three years before the deadline for submission of tenders, and if the period of conducting business activity is shorter – within this period, it has performed or is performing at least 2 (two) contracts for an entity/entities using IT systems, whereby:
- at least one contract covered maintenance services provided for at least 11 months, which consisted in ensuring the availability of the IT system covered by the service in accordance with the agreed SLA (specified response and issue resolution times);
- at least one contract lasted for at least 11 months and covered the provision of software development services (at least once), which consisted in tailoring the IT system to the needs defined by the Customer, and this tailoring consisted at least in developing or modifying the source codes of that system in order to build new functionalities; It is permissible for the requirements specified in points
- and
- to be fulfilled under the same (single) contract. In such a case, however, the Economic Operator shall be required to submit a second, separate contract (performed for the same or another entity) confirming the fulfillment of at least one of the requirements specified in point a) or point b).
- In order to confirm the fulfillment of the above condition for participation in the procedure, the Contracting Authority shall call upon the Economic Operator whose tender was evaluated the highest to submit, within a designated time limit of not less than 10 days, subjective means of proof, valid as of the date of their submission, i.e., the Economic Operator shall be required to submit a List of services performed, and in the case of recurring or continuous services also being performed, within the last 3 years, and if the period of conducting business activity is shorter – within this period, specifying their subject matter, dates of performance, and the entities for which the services were performed or are being performed, along with evidence indicating whether the services were performed or are being performed properly;the evidence in question comprises references or other documents issued by the entity for which the services were performed, and in the case of periodic or continuous services are being performed, and if the Economic Operator, for reasons beyond its control, is unable to obtain these documents – a statement of the Economic Operator;in the case of recurring or continuous services still being performed, references or other documents confirming their proper performance should be issued within the last 3 months (it is recommended to draw up the List of services in accordance with Annex No. 7 to the Tender Specifications [SWZ]).
- In the case of Economic Operators applying jointly for the award of the contract, the fulfillment of the condition specified in point 1 above must be demonstrated by at least one of these Economic Operators, whereas the absence of grounds for exclusion and restrictions on applying for the contract referred to in point 2.1.6 of the notice must be demonstrated by each of the Economic Operators.
- In order to confirm the fulfillment of the conditions for participation in the procedure, an Economic Operator may, where appropriate and with regard to a specific contract, or a part thereof, rely on the technical or professional capacity or the financial or economic standing of third parties making resources available, regardless of the legal nature of the legal relationships connecting it with them.
- With regard to conditions relating to education, professional qualifications, or experience, Economic Operators may rely on the capacities of third parties making resources available only if those entities will perform the services for the execution of which these capacities are required.
