What the buyer wants
- The subject of the contract is the provision of a technical assistance service for Oracle software. The detailed description of the subject-matter of the contract shall include the model contract (with the Annex), which shall be annexed to the WWZ.
- The Contracting Authority requires that the subject of the order be provided by the Contractor, who has the status of an official Oracle trading partner and is entitled to resale of the manufacturer's products. The aforementioned status should be verified by the Contracting Authority, in particular through the Oracle manufacturer's website: https://www.oracle.com/partner/find-partner.
- The Ordering Party in this procedure does not divide the contract into parts, nor does it allow the submission of partial tenders. The subject matter of the contract should not be divided into parts for technical, purposeful and economic reasons.The lack of division of the subject matter into parts is an objective circumstance resulting from the nature of the contract, which constitutes a coherent whole - all its elements are linked and affect the quality of the service.In addition, the lack of division into parts does not restrict access to orders for micro, small and medium-sized enterprises, and Contractors operating in the sector covered by the contract can provide parametric licensing packages along with support service.
- The Contracting Authority does not require the performance of the contract by protected work establishments, social cooperatives or other economic operators covered by the provision of Article 94(1) of the Act.
- The Contracting Authority does not require the employment of persons based on employment relationship.
- The Contracting Authority does not provide for the possibility of awarding contracts referred to in Article 214(1)(7) of the Act.
- The Contracting Authority does not allow variants to be submitted.
- The Contracting Authority does not foresee an electronic auction.
- Prior to the initiation of the procedure, the Ordering Party did not conduct preliminary market consultations. (10) The Contracting Authority does not require Contractors to submit the evidence in question.
- The Contracting Authority, within the limits of the provisions of Art. 462 et seq. of the Act, allows the Contractor to carry out the subject of the contract using subcontractors. The contractor who intends to entrust the execution of part of the contract to subcontractors shall indicate in the tender the parts of the contract which he intends to subcontract and the names of any subcontractors, if already known.
- Reason for applying the criterion price 100% - Quality requirements referred to in Article 246(2) of the Act, The Contracting Authority shall describe in detail in the template of the contract, which shall be annexed to the WWZ.
