References Minimum requirements: The tenderer demonstrates its technical and professional ability by submitting a minimum of two and a maximum of five relevant references regarding the development, implementation, and/or management of a gift voucher system for cities or municipalities.

The submitted references must meet the following minimum conditions: the reference relates to a gift voucher system developed for a city or municipality of a size comparable to that of the City of Lier; at least one hundred merchants are or were affiliated with the gift voucher system; the services to which the reference relates were performed during the last three years, calculated from the deadline for the submission of tenders, or are still being performed on that date.

For each reference, the tenderer provides a concise description of a maximum of 500 words.

This description must contain at least the following information: the name of the city or municipality; a description of the nature and scope of the contract; a description of the implemented gift voucher system and its main functionalities; the period of performance and, where applicable, the duration of the cooperation; the number of affiliated merchants; the role and specific responsibilities of the tenderer within the contract; the current status of the contract: completed or still in progress; the name, position, telephone number, and email address of a contact person at the relevant city or municipality.

Only references that are described with sufficient clarity and verifiability, and that demonstrate that all aforementioned minimum conditions have been met, will be taken into consideration. The contracting authority reserves the right to verify the submitted references with the stated contact persons. By submitting the references, the tenderer grants permission to contact these persons.

If fewer than two valid references are submitted or if the information provided does not demonstrate that the minimum conditions are met, the tenderer will not be selected. If more than five references are submitted, the contracting authority will only take into account the first five references in the order in which they appear in the tender.

The proposed team must collectively possess the expertise required for the implementation, commissioning, support, and ongoing operation of the gift voucher system. The team must at least include expertise in the following areas:

  • project management and coordination of the implementation;
  • technical implementation, configuration, and data migration;

For each team member, the tenderer shall attach a concise curriculum vitae or equivalent document that demonstrates the stated experience and expertise with sufficient clarity and verifiability.In addition, the tenderer provides a simple organizational chart or team diagram showing the mutual division of roles, responsibilities, and back-up arrangements. Only profiles whose expertise is demonstrated with sufficient clarity and verifiability will be considered for the assessment of this minimum requirement.If the information submitted does not show that the proposed team collectively possesses all of the required areas of expertise listed above, the tenderer does not meet this selection criterion and will not be selected. The staffing proposed in the tender serves as the baseline for the execution of the contract.If a proposed team member is replaced during execution, the replacement must possess at least equivalent relevant expertise and experience. The contractor shall notify the City of Lier of such replacement in advance and shall provide, upon request, the necessary supporting evidence demonstrating equivalence.

* The ESPD, by which the economic operator declares that it is not in one of the situations of exclusion referred to in Articles 67 to 69 of the Law of 17 June 2016. Article 70 of the Law of 17 June 2016 on public procurement applies.

For the exclusion grounds referred to in Article 67 of the Law, the candidate or tenderer shall, on its own initiative, state whether it has taken the corrective measures referred to in Article 70(1) at the start of the procedure. * This provision applies individually to all participants submitting a tender together as a consortium, and to all third-party entities on whose capacity the tenderer relies, where applicable.

The tenderer must not be in one of the situations referred to in Articles 67 to 69 of the Law of 17 June 2016. This includes mandatory exclusion grounds, exclusion grounds related to tax and social security debts, and discretionary exclusion grounds. If an aforementioned exclusion ground applies to the tenderer, the tenderer must spontaneously prove that the corrective measures it has taken are sufficient to demonstrate its reliability despite the applicable exclusion ground.

It shall attach the relevant evidence to its tender. If the contracting authority deems this evidence sufficient, the tenderer concerned will not be excluded from the award procedure. By submitting a tender for this contract, the tenderer declares that no exclusion ground applies to it, insofar as these concern exclusion grounds proven on the basis of documents that the contracting authority can retrieve electronically itself.

This specifically concerns the NSSO (RSZ) certificate, the certificate of tax debts, and the "legal status" certificate. However, the tenderer must attach the following documents to its tender:

  • the Belgian tenderer employing personnel subject to the social security legislation of another European Union Member State: a recent certificate issued by the competent foreign authority confirming that it has met its obligations regarding the payment of social security contributions in accordance with the legal provisions of the country where it is established. Foreign economic operators are requested to attach to the tender all documents that the Contracting Authority can consult directly via the Telemarc application for Belgian economic operators, namely:
  • the certificate of declaration and payment of social security contributions from the NSSO (RSZ);
  • the certificate of VAT liability and the certificate of tax debts (FPS Finance);
  • the legal status of the economic operators (non-bankruptcy or similar situation) at the Crossroads Bank for Enterprises (or CBE); * The tenderer shall attach a recent extract from the criminal record relating to the tendering legal entity. The extract must not be older than six months on the final deadline for receipt of tenders. The contracting authority reserves the right to request additional supporting documents if this is necessary for verifying the exclusion grounds.
