Pursuant to the provisions of Art. 186 of Law no. 99/2016 on sectoral procurement, economic operators submitting a tender must demonstrate their personal status (form of registration or professional affiliation, in accordance with the legal requirements of the country in which the economic operator is established). In this regard, economic operators submitting a tender must prove a form of registration under the law of their country of residence, showing that the economic operator is legally established, is not in any of the situations of annulment of incorporation, and has the professional capacity to carry out the activities that are the subject of the contract. Means of fulfillment: The economic operator will fill in the Selection Criteria Section in the ESPD: A. GLOBAL INDICATION FOR ALL SELECTION CRITERIA. Supporting documents proving fulfillment of the commitments made by completing the ESPD, namely a certificate of status issued by the ONRC (National Trade Register Office), or in the case of foreign tenderers, equivalent documents issued in the country of residence, are to be submitted, upon request by the contracting entity, only by the tenderer ranked 1st in the intermediate ranking drawn up after completing the evaluation of tenders. The supporting documents must be valid on the date of submission. The requirement also applies to associated tenderers and subcontractors, as appropriate.

Information and/or minimum level(s) required for assessing compliance with the mentioned requirements The bidder/consortium may resort to subcontractors for the performance of part(s) of the sectoral procurement contract. Manner of fulfillment: In the event that the bidder/consortium resorts to subcontractors for the performance of part(s) of the sectoral procurement contract, the subcontractor(s) are required to complete the ESPD. Together with the submission of the ESPD, the subcontracting agreement(s) concluded between the contractor and the subcontractor(s) nominated in the tender shall be submitted SPECIFYING THE CATEGORIES OF SERVICES FROM THE CONTRACT THAT IT INTENDS TO SUBCONTRACT, AS WELL AS THE PERCENTAGE OF THE CONTRACT TO BE SUBCONTRACTED BASED ON THE RESPECTIVE AGREEMENT. Only the provision of services ancillary to the supply may be subcontracted, if applicable. It shall be taken into account that the supply activity cannot be subcontracted, pursuant to Art. 3 para. (1) let. zz) of Law no. 99/2016. In accordance with the provisions of Art. 232, para. (4) of Law 99/2016, the contracting entity has the obligation to request, upon contract conclusion, the presentation of the contract(s) concluded between the contractor and the subcontractor(s) nominated in the tender. The subcontracting contract(s) presented upon the conclusion of the sectoral procurement contract shall be consistent with the tender and shall constitute an annex to the sectoral procurement contract. The contractor's liability regarding the performance of the contract is not diminished in the event that part/parts of it are performed by subcontractors. In accordance with the provisions of Art. 187 para. 1 of Law no. 99/2016, the contracting entity reserves the right to request the bidder ranked first in the intermediate ranking drawn up after the completion of the tender evaluation to transmit relevant information and documents concerning the technical and professional capacity of the proposed subcontractors, with respect to the part/parts of the contract that they are to actually perform. The supporting documents proving the fulfillment of the commitments made by completing the ESPD are to be submitted, at the request of the contracting entity, only by the bidder ranked first in the intermediate ranking drawn up after the completion of the tender evaluation.
